I worked with over 7000 businesses.
If I knew one of them to be dishonest, I would not place ads for them.
But it's the job of the agency to support the client.
The one paying for the marketing is ultimately responsible to the public for their faulty product and will have to face the music in the event of a lawsuit.
Consider various drug companies that have recalls of bad products that later cause side effects.
The TV stations and other media are not sued because they placed their ads. The suit would be against the drug company.

FYI FOLLOW-UP FOR BRAD: You are obviously not in the advertising world and not well informed. The media is NOT responsible for faulty porducts and therefore is NEVER sued for advertising.
They sign disclaimers with the client stating as such, before an ad is ever run, for that reason. How can they know of eny possible issue with all the compnaies they represent?
I ran an ad agency and know the rules. It's alos true of websites that have ads on them for other buisnesses.

A car company can still buy ads for a car that explodes. As long as the ad doesn't state that the car has never exploded then it's not false advertising. |

Well, I haven't read any bad press about exploding cars.... Advertising for a bad product isn't false advertising unless you make false claims. So just don't create an ad that says "our cars don't explode."
In all seriousness, the advertiser (client) carries the liability - even if they are acting on bad information/advice from their agency. This actually happened to me in a dispute with the SAG union when our agency advised us that we were ok to use non-union talent. We got sacked with the fine, even after said agency was fired. |

I would hope the car company would fix the problem.That being said the ad should be honest and upfront and bring the problem to out then show that it has been fixed.Now to answer the question if this method is not chosen(likely wouldn't be)If the ad company knows about the problem then they are responsible for the false advertising.If the problem is not public knowledge and the car company doesn't tell the advertising firm then its the car companys fault.
