Can a magazine be sued for giving award to my competitor but not me?
My competitor products may not be better than our products, however they have just won an award from SC Magazine and our company has not. Can a magazine be sued for giving so much importance to our competitors. We can prove in a lab test that our products perform better than our competitors.
The magazine is allowed to give awards to whoever they want to without being sued by other companies because they disagreed with the reward, even if there is laboratory evidence. Many magazines give extra publicity to advertisers willing to sign an annual agreement with them. If you beat them at their game and market your superior product successfully you will eventually overtake the competition.
If someone is injured or suffered financial damages based on the content in the magazine, then it is possible that the magazine could be held liable, especially if the information came from their editorial staff and is not a paid advertisement.

A lot of those awards are the result of readers' choice, and while your product might work better in a lab situation, perhaps it does not work better in real-life applications.

Here's an idea...why don't you try to learn something about marketing. That way you will understand how smart your competitors were to put themselves in a position to gain such recognition.
Just about every type of business on the planet has to deal with competitors who make an inferior product but are getting all the sales. They deal with it by becoming savvy marketers.
If you can prove your superiority..then I'd say your in a real good position to overtake your competition easily with some aggressive marketing to help get the word out.
You may be superior with the "Product" , but they are better than you at marketing and PR than you, right now, and apparently its allowing them to kick your butt.
So...you get better at them in that game, and you will ultimately win because you DO have the better product.

Yes, I think you should because if I was your competition I would take the high road and let you hang yourself because you want to sue a magazine over an opinion.
