intellectual property law dictates that you can certainly name a company using a common name... take Apple, for instance! The copywright applies to the business name (Apple Computers, Inc.) If you were a company like Bath and Body Works and you created a product called "Bees Wax" that is perfectly legal, and you can trademark any unique formula under the name of "Bath and Body Works Bees Wax" but you cannot reserve rights over the name Bees Wax and prevent others from using it, of course. |

You can trademark anything, if you check in the trademark website, someone trademarked the name "alpaca" (and lots of other words with alpaca in them). The hitch is that if someone else uses your name, you can sue them, and then their defense is that it's a common name, and your trademark means nothing.
