Help needed urgent-- Ebay?
ok i bought a brand new bed from a power seller for my daughter...was over £150.It arrived and poles were missing.

I contacted the buyer and from the reply I got it appears they are dropshippers and cant get spare parts.

I packaged the bed back up cos it's not safe with the missing parts...

I started a claim with paypal and this has gone on for weeks...I've just been told I can't have my money back!! nor the spare parts??

What do i do? I am £150 out of pocket and I have a child with no bed?

I cannot afford to replace.

What do i do??

It's not your problem if the seller uses drop shippers.

If they are Power Sellers, they are required to be registered with eBay as 'business sellers', which means that you're covered by the Distance Selling Regulations, IF the bed was a Buy It Now listing.

You need to start a 'dispute' for 'item not as described' with PayPal within 45 days of making the payment, then escalate that dispute to a 'claim' within a further 20 days. If you fall out of those timings, you're out of luck with PayPal - hard on you, but that's how it works.

If you made the ENTIRE payment with your CREDIT card you can try contacting your card issuer and see if they will help.

There's an awful lot to look through here
http://pages.ebay.co.uk/help/policies/business.html
but this page shows the legal requirements for 'business sellers' on eBay.

At the very least, send your seller the link so that they know you're aware of your rights (even if you have 'timed out' with a PayPal claim).

In all honesty, this probably won't do you personally much good, but if you've timed out with PayPal, start a dispute through eBay and report them to eBay as 'non performing sellers'
http://pages.ebay.co.uk/help/policies/seller-non-performance.html
because it will at least get them a 'black mark' behind the scenes

If you paid by credit card, you are protected for this sort of thing so give your credit card company a call. If not, then you need to contact paypal and Ebay again... hope you get everything sorted out

I've never had this problem before, but you could pursue a Small Claims Court order?
This ha more information tah what I can tell you:

paypal take 90 days to settle claims. contact ebay about it, if youve got the address etc go to the C A B

Try contacting paypal again directly...i think there must be a way on contacting them or email ebay or something explaining it all...
hope you get it sorted

learn all you can about the seller like what was described, was it accurate, go back to the original auction where you purchased the bed etc. there will be lots of information there. you can appeal paypals decision, if the bed was not as described you still have a chance of success.

I am afraid if you tried to re-sell on ebay you would still have the problem as your buyer would of course reject the item.

If opening a dispute and trying to claim a refund or get spare parts doesn't work you could try reselling the bed. Usually, especially in a case like this, ebay side with the buyer. But if not, assuming you can't get the parts cheaply (is anyone else selling them on ebay?) then you could try reselling. You may not get £150 or you could be really lucky. But if you can't use it, can't get parts and have no cash to replace it then it doesn't hurt to try and resell
