Napster was located in the US and was the first major target of the RIAA's anit-P2P litigation efforts. Kazaa is not located in the US, making some anti-piracy efforts murky. However, Kazaa also made efforts to distinguish itself from napster by attempting to limit the distribution of copyrighted materials on its networks. Limewire is an interface to a network using the Gnutella protocol, which is a decetralized P2P protocol written by the creators of Winamp. Limewire (and other Gnutella clients) operates by connecting users directly to other users rather than to a single set of servers. This makes shutting down those networks considerable harder. The same decentralized philosophy used in Limewire is also used in Bittorrent, however Bittorrent requires that a user upload as he or she is downloading. Also, Bittorrent has been embraced by the Open Source community as a legitimate tool for legally distributing software. |

I believe that is because of how the information is delivered. With Napster, everyone logged on to the central Napster site and could browse and download each other's stuff via Napster's servers.
With these other companies I don't believe they act as an actual conduit through which the files can pass and since it is decentralized, the other companies really can't be shut down easily, so it's easier to prosecute the people sharing the files instead of prosecuting the company. |

Because programs like Kazaa and Limewire are not supplying the music, they are only supplying a program that allows you to share files with other people..what you do with that program is your business, and it is you that is in turn breaking the law when you download without paying for any music or videos. File sharing is used all the time in business, when you create a document or a photo, and share it with others it´s okay cuz its your material. |

I'm not sure about what happened to napster exactly, but I know that Limewire and Kazaa are based in countries where there is no law against those kind of sites (places like Japan and Korea, I think).
What's illegal is to download; the creators of the program are not liable. |
