I have created a logo for a company and wish to copyright and trademark the image, as it will be used for merchandising and advertising, and i do not want the logo to be copied and used by other companies. This is the first time I have done this and I am not farmiliar with the registration process, can anyone recommend the best way to do it, and if it is a free service or will i need to pay to register? Probably the company who you work for, should get the trademark registered. The US Patent and Trademark Office (www.uspto.gov) is the agency to handle this.
It cost money for the filing and registration process. The trademark attorney will also charge you for their service. You need to identify which product or service the trademark representative. |

You would need to trademark it - not copyright it or patent it. To start - just put a tm in a circle above the upper right corner of the design - this indicates an unregistered trademark - google "trademark registration" and you should find some links to government site to get you started. When the trademark is registered, you would change the tm to an R in a circle - look at different logos and you'll see tm or R with the image |

Yes, there are fees involved but that is the cost of doing business and it is worth it to protect your new brand.
While the USPTO will profide you everything you need to do it yourself, you may still want to consult an attorney or other trademark professional to fully ensure all your bases are covered, all your i's are dotted and all your t's are crossed.
The online legal site, LegalZoom.com, (which was co-founded by Robert Shapiro) has a trademark service, as well as, an educational center on trademarks.
I haven't used LegalZoom but I have heard good things about them.

Hey Vanilla, roibert.com gave some great advice. I love this kind of stuff. I would also suggest finding a patent or trademark (Intellectual Property) attorney. A general law practitioner could file the proper documents for you, however, it sounds like this is the first but not the last time you want to do this so find a specialist. A Intellectual Property Attorney would be great find and your best friend. It really pays to protect your assets. In this case, your ideas.

You need to go to this website, where you will find all of the information you need to register a trade mark in the UK.
You'll need to fill out a TM3 form, and submit online, or send it off, with a fee (of course) - £200 I think for 1 class, £50 for each extra class. |
