Very first thing to do is do a patent search. I googled key words that described my idea, or what I called it and added "patents". Like "automatic widget patents".There you will find patents for items similar or maybe exactly what you have in mind. If you have determined then that your invention is not already patented, then you can move on. You will see on the site that you will have to have an abstract, a drawing or description of your invention. I'm suspicious of patent attorneys. However, I do think that having one is in your best interest. Select a patent attorney carefully. They advertise on tv, in the phone book and on the web. Be suspicious b/c once your invention is known, its too late to find you've been 'taken'. Just as you would do for paying for any other service, check out what they will do for you. I'd ask about ppl they've represented that have products out there and check out the validity of thier claim.
From there you will be guided through the rest of the process-i.e. you may need a prototype, there may be fees here and there to apply for a patent, and the way a patent is applied for may be all legal schmegal. Once you apply for a patent, it may be years before one is issued. You've seen products that say "Patent Pending" I'm sure. I'm guessing that an individual not unlike yourself applied for a patent and a company bought the idea from the individual before the patent was issued. This tells me that you can pitch your idea at that point to a company, sell it, and the co is now owner of the idea.
Copyright applies to the written word. Books, magazine articles etc-written pieces get a copyright. Nothing to do with inventions.

I have used Pressman's Patent It Yourself since the late 80s to file and process 18 patents, and have saved myself and my business partner (a lot of money) in legal fees. I can't recommend this book highly enough. Pressman is not just knowledgeable, he is a master teacher, imparting information with consumate pedagogic skill. He makes learning of complex legal issues as easy as one can imagine. His prose is often humorous and entertaining as well.
One recommendation: If you use this book to write your first patent filing, let a patent lawyer review the filing before you submit. This shouldn't cost you more than an hour or two in attorney fees and from my experience can enhance your submission and improve its chances for allowance significantly. I did this for my first several submissions and learned something each time. Eventually there was little the attorney could offer, and I then ceased the practice.
Wish I could give 6 stars for this remarkable book.
Plus if you are thrifty like like the thriftiest person beyond thrifty you could get a previous edition and then read the tome while eating three complimentary value meals http://www.amazon.com/gp/offer-listing/1...

Your best bet is to consult an Attorney - I am not one, but have some experience in this area with my copyrighted works. The most important thing for you to do is to protect yourself and the great idea you came up with. When researching on your own, it is also important to check with the government agency responsible for that particular area. There are plenty of so-called experts out there who - for a fee - will rip you off. Get good advice from good sources. For example, the US Copyright office is responsible for issuing copyrights. Depending on what you plan to copyright, a specific form is used. Also, don't forget about things such as trademarks, ISBN numbers, websites, and other important things to surround your idea completely. As far as patents, an Attorney can help you save time, money, and ultimately protect you and your idea. Some companies like to buy your patent and never bring it to market because it would negatively affect your business. For example, we're just seeing more and more of hybrid cars when electric cars have been available, yet in a holding pattern for a number of years. Bottom line - do your homework. Learn as much as you can from others who have learned from their mistakes. Success is great, but a lot of work and patience is required. Enjoy the ride, because there is nothing like taking your own idea and creating a copyrighted or patented product that can help others or eventually become a business. |

If it is an invention, you want a patent, a copyright protects a work (song, play, software code, etc.) from being copied, a patent protects a useful method, apparatus, or design. Step one should be to check out the patents page at www.uspto.gov, this can help you understand patent law a bit better before you determine whether to go to an attorney with your idea. |

It begins with retaining a patent attorney who starts the registration process by conducting a search of PTO records and related invention servers to find if your product is unique and patentable. Then begins a series of patent processes involving an Patent Application, an Office Action and then a Preliminary Finding which is then posted on the PTO Gazette for public review and access. The whole process can take many months or years depending on whether you merely want to register your patent exclusively in the U.S. or take it further into other countries, in which case, you have to file separate Patent registrations. The initial fee for a U.S. patent attorney [who has passed the Patent Bar] is around $20,000 per invention.
