Is it false advertisement if there is an item in store but you cannot purchase it?
So I went to Wal-Mart to buy this DLP HDTV they had there for quite a few months. The attendant goes in the back to see if there are any there but alas there were none and they could not sell the one on display. It was clearly labeled at $650. Does this constitute a form of false advertisement and who would i report this to if so? Additional Details some of you are under the impression that this was on sale, but it was not, and the TV on display in question has been there for over three months now. any change in answers?
If it is a vendor provided display it is not their product to sell as it is not part of Wal-Mart's inventory. Some vendors do require there display back. Also if you look at the store policies & ad information you will see that quantities are limited not all items available at all locations. Wal-Mart has the right to limit quantities.

Well, you would have to prove they never had any of the product or only small number of it. And that is almost impossible to prove.

Typically, no. The item you see on the shelf may be the display item. Typically, it lets you know what you can order. If they sell the display, then you won't know what to order.

I would think that Wal-Mart should be able to order the HDTV for a sale price of $650 for you. I agree with one of the previous answers that Wal-Mart should not necessarily have to sell you the display model.

Places link walmart set up their displays but then don't get the opportunity to take them down the second that they run out of the inventory.
About them not selling the item on display is probably because they will keep selling that product but just not at that price. Because of that if I were you I would have asked if they could do a raincheck so that when they do get more of that TV then you can still get it at the sell price since they ran out and it wasn't your fault.

If they don't want to sell the display item and you're worries they will rise the price you could ask for a rain check. I think it does constitutes false advertising if they are advertising something they do not have in stock. you can also ask to speak to the manager of the store.
