No, the instant the photo is taken, the photographer gets copyright of the image, the same happens when you write or type something.

Copyrights are massively abused on the web, with people taking photos from others sites and using them without permission. However, this is most usually on personal sites so people are allowed to get away with it, although they could in theory get sued.

If someone elses images are used though in a way that earns the person revenue, then you`ll find yourself in trouble from the owner of the copyright, be it the photographer or their agency.

You should always ask permission from the owner of the copyright in situations like this, unless you have bought a royalty free stock photo for example, but again you need to check the terms and conditions that you bought it under.

It is not legal without permission. The rights to celebrity photos are always highly protected, as they are worth a lot of money.
The copyright (legal ownership) is usually held by the phothographer who shot them.

I take freelance pictures at the Kansas Speedway and ALL photos are allowed to be taken, but the rights to them remain the tracks so if THEY want to sell them they can but I can't, I can however have a group pay me to take ANY picture for their use and then I get around the selling picture by picture.

So in your case the pictures you have taken are reserved rights to the "organization" the celebrity works for ie. EltonJohn Inc. Even though Mr. John is the whole INC. If you want to publish them you need to ask permission from each of the photos "rights" owner they usually will let a person do this on a onesy twosy basis but if you are publishing for profit then of course they will want to get in on the profits just like the record comapanies want royalties from all copied songs as you can see without their Celeb photo you have nothing. Give it a whirl you may be the next unknown Paparazzi king....

One More thing, If you are taking them from the Internet then I bet the "rights" owners have given the websites permission, therefore if there is an all rights reserved disclaimer on the site you have to ask that sites owner. if they have the rights to them. Otherwise it is back to the Celebs publicist they can get you what you need.

Very much illegal --- without the consent and release of rights from the photographer who created the photos !!
Each photographer that creates a photo -- has the "rights" to that work !! And, each photo OF a professional photographer is considered "copywritten" product !! In order to use that photo in ANY publication --- and, especially publications meant for commercial distribution (sale) -- you must obtain the "release" of those rights FROM the photographer OR their agent !!

The celebrities themselves are considered "public domain" and no need exists to get THEIR approval or release --- they are "public figures" and the production of their photos (unless those photos are made INTO a product --- such as t-shirts, mugs, posters, ect) are considered "news" items -- and, AS such, are available for use !!

It would serve you well to contact a "media savvy " lawyer and put them to work at obtaining the releases from the individual photographers to facilitate this undertaking -- and, I think you'll find that it isn't nearly SO difficult OR expensive to obtain these releases as one might suspect !!!

The photos are still copyright protected by the photographers that took the pictures. Attempt to find the photographer, and get permission, if you don't and your book get's HUGE the photographer that took the picture could sue you and get royalties from the book. (Get it in writing so they can't deny it later) and publish the book!
