Isn't it false advertising for websights to say "You are the 999,999th visitor! Click to claim you're prize!"?

It's not really false advertising in the legal sense.

To be liable for common law false advertising, the offender has to do more than simply make a claim or statement that is technically untrue.

More specifically, the false claim has to deceives or have potential to deceive the intended audience, it has to be likely to actually affect the purchasing decisions of its intended audience, it the advertising involves goods or services in interstate commerce, and it has to cause or be likely to cause harm or injury to the recipient of the statement or claim.

The most important part of the analysis is usually the severity and degree of the potential harm to consumers.

These factors will vary depending between jurisdictions; most states have consumer protection statutes (for example, the Texas Deceptive Trade Practices Act) that define "false advertising" in a state-specific way.

It isn't false advertising on the part of the website because those are advertisements. They aren't owned by the website, and the site isn't required to regulate them.

False advertising yes, but illegal...no. If you are selling banner space then the ad isn't even yours to begin with. There have been cases of flashing banners with bright colors to cause seizures in people. I have not heard of anyone getting sued over this though.

Yes, it is actually a false statement for matured internet users.
But every day new comers are there, so those people are surviving.
If you are going to sue them, they will proof that you were that number.
In the internet advertisment any body can say anything, but good web sites will not show like that cheap advts.

While good search engines will also never give rank to those false claims. For example if they write we are the No 1 web site, those search engines will filter them out as there in the internet no body can claim ranking by them selves.

It certainly is misleading, if not technically illegal.

The problem is that even if it is illegal, the cost of trying to sue them would be prohibitive.

There are tow ways they can be stopped:

The websites on which they appear can decline the ad revenue, but I doubt if any site owner would turn away good money.

The other way is for people to stop clicking on the banners - if nobody ever clicked on them they would go away very quickly!

the out they have is that they do not tell you what you are the 999,999th visitor of...so they can claim anything. so not illegal. Of course, if you think you actually won something and clicked on it, they you get what you deserve.

As for the second part of the question, I gotta say I dunno. What boarder? (or is it a border? or perhaps a red flashing snow boarder? Are they that common?) You have me very curious...
