"What uses of photos, clip art, and font images are prohibited?

Although these examples do not represent an exhaustive list, you are not permitted to do any of the following with the photos, clip art, font images etc. (“Media Elements”) in the Software Product:

You may not sell, license or distribute copies of the Media Elements on a stand-alone basis or as part of any collection, product or service where the primary value of the product or service are the Media Elements.

You may not use or distribute any of the Media Elements that include representations of identifiable individuals, governments, logos, initials, emblems, trademarks, or entities for any commercial purposes or to express or imply any endorsement or association with any product, service, entity, or activity.

You may not create obscene or scandalous works, as defined by federal law at the time the work is created, using the Media Elements.

You must indemnify, hold harmless, and defend Microsoft from and against any claims or lawsuits, including attorneys’ fees, that arise from or result from the use or distribution of Media Elements as modified by you.

You must include a valid copyright notice on your products and services that include copies of the Media Elements.

It'd probably be best & easiest to have a design created from scratch. Make sure it's legally available in respect to trademarks and if it is, you can then decide if you want to file for a trademark. I posted some handy links for you.

i'd come up with something unique and copyright it. i believe ms clip art is protected. whenever you try to download it from their website, some 'agreement' type document comes up. i'd check it out...better safe than sorry.

Do yourself a big favor and hire an artist to do a unique one for you, it should be less than 50 bucks

Yup, without question. (Good instincts!) You would be better off trying to draw your own angel and scanning the image to make your own "clip art" -- but don't do anything silly like tracing or side-by-side drawing with the copyrighted one! You could also contact Microsoft about licensing the use of their image, but they don't have a reputation as sweethearts when it comes to sharing or playing nice with others. Good luck.

The honest answer to your question lies in the terms of service by which the works were licensed. Clip art can be licensed under a very wide range of terms and some allow resale while others do. You should check the user agreement for that particular clip art collection (Microsoft actually has released several) and see what it has to say.

Personally, I think it would be a huge waste to use such a clip art for that purpose. It will be immediately recognized as a clip art and it is so easy to either hire an artist to create a new work for you or find a pubic domain work that you can use without fear.

There are many good logo design shops that will produce a new work for less than 100 dollars with no restrictions.

Even if you could use it, dont! Clipart can not be copyrighted or trademarked. Any competitor could take that same clipart and create a logo and there is nothing you could do about it.

The purpose of a logo is for people to remember your product or service. A logo needs to be unique and distinctive. Go to elance.com and post a logo project. There hundreds of designers will bid on designing a custom logo for you.
