My husband is a graphic designer and is doing quite a bit of free-lance on the side. He has just started making designs to screen print onto t-shirts but we're wondering how he can sell the shirts but also protect his designs as his own. Does anyone know how he can keep others from ripping off his designs? |

Sadly, there really isn't a way for him to make sure that his designs won't be ripped off.
That being said, though, what he can do is make sure that he protects his designs so that if they are duplicated, he can take legal action.
1. Create a company, like a single-member LLC (This isn't a must, but for multiple reasons it might be wise to do so if he doesn't already have a company.)
2. If at all possible, have custom sew-on/screened on labels for the T-Shirts made, to further brand his designs
3. Then... copyright your heart out
Copyrighting how-to's can be found at http://www.copyright.gov. Start there BEFORE you go to an attorney or any such thing.

He can copyright them. Fabric Design including T-shirt stencils or designs are fully copyrightable visual arts. I own several T-shirt design copyrights myself!

Hi There,
Congratulations on the being able to create something original. I hope it will sell well. I know most people are concerned about being ripped off. However much you protect the design of t-shirt especially, there is bound to be copy cats.
Some may say that immitation is flattery.
Well you could develop a brand and sell it like limited edition. However your brand needs to be well known before that has any real value. Unfortunately even big brands have copycats.
Just to be realistic, register your copyright, made it known that the design is copyrighted, sell your products. I am sure with huge sales your husbands creativity will be amplified. If it is copied, reserve the right to sue when the design really sells, if they copied and can only sell 5 pcs. There is not much to be made there if the copier is a small timer.
Working on copyright protection is important but it does not pay the bill if your products do not sell. Sell your products first and then if it is copied make a big hoo haa, use it as a marketing leverage for new products. No use being worried about copyright and not selling it. If the price is reasonable, there is no need to copy as the margin will not be much for the copier.
