Shawn T | Using a Marvel character name for unrelated item? |
Hello, we are working on a red iron management system that will track testing of industrial flowline products. We would like to call this system "Iron Man" for short but I'm not sure if Marvel would sue our asses for it. We would not be using the spelling "Iron-Man", feature the character at all and would not even sell it as a service. This system is for use by employees.
I can't wait weeks to get a response from Marvel so I am asking here if I should even attempt it or just move on to a new name.

I've seen it used in lots of places. Even if Marvel found out about it, and assuming they cared and could legally stop you, they would send you a "cease and desist" order (warning) before taking any legal action. |

I would not even touch it.
A few years ago when SPIKE TV was launched, they were sued by Director Spike Lee. SPIKE TV eventually won the right to use the name, but it was not before they had spent hundreds of thousands of dollars in lawyer and court fees.
Corporations such as Marvel comics spend a good deal of money protecting their "products", and you surely have an issue with them if you attempt to use the name of one of their characters. Even if you win, you could still lose.
From a marketing perspective, I think you would be better off investing in a marketing consultant to come up with a new name for your product that is not copyright protected (hint, hint) versus spending that same amount of money to an attorney.
A few years ago, the Disney corporation forced a child's daycare to paint over the Disney characters it had painted on their classroom walls. Petty? Perhaps. But, as I say, corporations take their business seriously. |

It's not worth the risk, because even if their lawsuit wouldn't have any grounds, you'd go bankrupt in lawyer fees before they will. |

I would try a different name. Although catchy, it could be a legal problem. Certainly people have sued for less. How bout Streamline Production Software? Or Efficient Production Practices? |

I would assume the image of Iron Man is trademarked, but the name, Iron Man, is used in some many other contexts, like Iron Man fighting contests, that using simply the name does not constitute an infringement. |
