What are the pros and cons of using a prominent persons name in a communication, without his permission?

i agree with Christina9999's answer.
some facts are already there so there is no issue with stating those known facts. unless u are defaming a person or stating "privacy facts" which the person doesn't want anyone else to find out. Safest way is to check with the relevant person's PA or something for a written permission least you get sued or something...

There's nothing illegal about publishing a well known fact or the name of a public figure. However, if you were to imply something about Bill Gates in your ad I could see you having problems. If you really feel it is necessary, I would call that person or their assistant and ask for permission to use it. As for payment, I don't think it's necessary.

As others have said, the example you're talking about is common knowledge so there would be no need to seek permission nor would payment be expected. Areas where you must be more careful is where you say something that is not common knowledge as - if sued - you would be expected to provide proof. The 'implying an endorsement without permission' is an excellent example, as would be any kind of false or misleading statement.

When in doubt, it is always best to ask permission first. Celebrities, like anyone else, have differing personalities and beliefs in so far as protection of their reputation. Many love to support worthy causes either through an endorsement, quotes, or direct sponsorship. They may indeed charge a fee, but it would probably depend on the who, what, and why of the situation. Key is to ask first, so permission of use is crystal clear.

If it's used in advertising, you may wanna contact Gates himself (which I doubt will happen) or contact his PR rep. If you use any person's likeness, especially a celebrity, you are liable for any and everything.

I hate to burst your bubble, but the "Bill Gates founded Microsoft" ad campaign is really being overdone nowadays. Everyday it seems I see an ad for Coke or Dell or Safeway and it's like "Try Our Product; And By The Way, Totally Random, Bill Gates Founded Microsoft." Dick Cavett once said to a guest that such random statements actually go much unnoticed and we rarely recall them; Foucault also posited that such signifiers further e(rode) rationalism in the discourse.

Your example is simply a statement of common knowledge. If you said something like Bill Gates uses Apple Computers at home, you better be able to prove it. If you said Bill Gates uses our brand of toothpaste, you'll need to get his permission, as this is an associated endorsement. Sometimes money is required, sometimes not. Many times if they truly like your product they won't charge anything, and may even provide a testimonial, and go one better.

You will need written permission to use some famous person's name in any advertising. The downside of it is that they will have no problem suing you if you do use their name. They have an office full of lawyers to stop this kind of infringement. A better marketing idea would be to brand it yourself. Ask yourself why would anyone shop at your business rather than your competitors? Customer service, quick repairs, knowledgeable employees, free parking, easy location, etc. Forget the idea of using someone famous in any kind of communication. It isn't worth taking the chance of a lawsuit. Besides, I'm not so sure it ever helps a business. The same would apply for using recorded music in an ad. Don't do it....it detracts from your message and you will be sued from BMI or AScap for royalties. And then you will have listeners just singing along instead of listening to your message.

Without the person's permission, you are asking for trouble. Can you prove the person said it, did it? You could be liable for slander, and that is hard core.
The example that you give is public information, so you would be fine in using something such as that. If you say, Bill Gates said, "..................................:" you could be in trouble.

No, because it is a fact and he is famous. But if you then go on and try to sell something or indicate he is promoting it, you're in big trouble. You need permission to use his name and image in that case, and will probably have to pay for it. Contact his attorneys.
