He can definitely sue you and your insurance agency and if he can demonstrate in court that he has suffered physically and has medical bills your insurance will have to pay him money. Could be thousands. This is why you have insurance. |

He can sue you. Even if his car is fixed by your insurance, he could have physical injuries, resulting in loss of earnings from work, medical bills....things insurance will not pay for. One thing you have on your side is that the brakes were faulty. Depending on the year/make/model of your car, YOU may be able to sue the manufacturer because if you have a new car, it wouldn't be your fault. And if the brakes suddenly stopped working and they were fine before the accident(and you have some sort of proof) you would more than likely win your case against the other driver. Yes, he can sue...your insurance does cover it but since it was your fault he can sue at anytime if he wants to..but if he was nice about it and everything was exchanged and taken care of I don't think you should worry... |

Well your insurance should cover it.... But it if doesn't cover it all I guess he could sue to get the rest of it such as if the car you hit was worth was totalled, he owed $25,000 on the car, but your insurance only gave him $24,500 he could probably sue for the other 500 if he wanted to.
If he got injured in the crash..... it depends on the state... Like minnesota has a no fault law... he can't go after you for injuries in minnesota.
I would say if you have insurance they will pay him off and you'll have to prepare for higher rates. |

If you knew your brakes were faulty and did not get them fixed, and your insurance company finds out about it, it might refuse to pay. If your insurance is less than the damages you caused, the man could still sue you for the difference, and if you're living at home and your parents knew the brakes were bad, he could sue your parents for letting you drive a defective vehicle, or just to see if he can collect from their house insurance. |

Ask your insurance company. He could sue you but you should win the case unless you did something else bad. You're insurance probably will cover some of it but not all of it for sure. Insurance companies are very cheap sometimes. You might want to keep the names of some good lawyers handy though. |

He can but if you had no knowledge bout the brakes and how often u should change them he most likely wont win, but why would he sue if insurance covers it? if insurance does cover it and he stills sues he definitely wont win but i dont know check out the other answers |

it should cover it but you need to check with tour insurance company if your policy covers your type of accident .usually full-cover is the only insurance that covers all the accident .also for the man suing you i dont think that's possible only if there was a life or death situation . the man is only going to call your insurance company to see if he can get money . your insurance could go up . |

Well, what i think the person may sue you. I think he or she will, but i dont think your insurance can't cover every thing, because is your fault too, because your breaks went out.. |

I'm no expert but usually people only sue as a result of accidents if the accident caused an extreme amount of damage and health care costs. Insurance usually covers these things. It is unlikely that the man will sue you because he's would need to pay a lawyer to sue you, for what, a wrecked car and a backache? (all of which insurance usually covers) |
