Demand to be told in writing precisely why they want to see them. If it is for an 'unlawful purpose' you can refuse quoting "I am entitled to refuse under 'Wandsworth v Winder, House of Lords 29th Nov, 1984' ". You could also try donating an 'Enduring power of Attorney' to someone you trust and refer the Council to them. They could then say "I am not at liberty to discuss any aspect of this person's estate with anyone as to do so would put me in breach of both my duty of confidentiality under the Data Protection Act and also under my Enduring Power of Attorney - where I have a legal duty and obligation to protect and safeguard the donors finances". If you have 'just cause' to refuse then see a solicitor, the CAB, etc. A court could order disclosure under threat of contempt for non-compliance. Depends on what you want to hide! |

If you do they will refuse to give you the Housing Benefit and will probably also want to reclaim that which you have already had. Benefit takes account of savings as well as income. |

At the end of the day, the council need to have proper and thorough checks before handing out money to people. If you were really desparate for the money then a simple formality like this shouldnt be a huge issue. Another point, bank statements, payslips etc etc arent interesting when you see them on a daily basis, there's no need to be paranoid about them frauding you or whatever you think they are going to do with them as apparently you dont have any money... |

I totally agree with you. It's a total intrusion into your private affairs. I was off on the sick recently and had to claim housing benefit, why should they all have a good look at your bank statements. There is probably a way you can send it direct to the main office, I just handed it over in the end. But I'm afraid they will insist on it. Sorry. |

If you do they will stop your claim. Its cr@p as well, I gave them my statements not long ago with regards to a claim, and on my bank statement I had a deposit of ÂŁ100.00 which was money I got from my parents, and the council classed it as income, even though I told them it was a present. |

Hi, unfortunatley they can suspend your claim on a lack of evidence basis... am afraid is real case of big brother, to claim housing benefit you are means tested therefore you have to prove you havent got a lovely stash of dough tucked away in your bank account. Is unfair and very intrusive but it just seems nowadays the council have the right to do what they want when they want. If you really need to claim housing (you wont get that much if your working anyway) benefit you will have to show them all the evidence they request. Hope that helps you. |
