I was injured at work and had to be taken to the emergengy room for stitches. Later that day, i returned to work to find out that i did not get paid for the time it took for me to get treated in the hospital, even though i returned to work the SAME DAY I was injured. I have been advised to consult a lawyer, but, i wanted to make sure i have a legitimate argument before i consult a lawyer against my employer. What do I do? |

Yeah, I say go for it. But is your employer only not paying you for the hours you missed? 'Cause then he might have you there. However, if you got hurt ON the job, then doesn't that factor in on your side. I mean, if getting a lawyer isn't a hassle, then definitely get one, since you want fairness. Hope that helps and hope your okay.

You have to miss 3 days before their insurance has to pay you.
And the company is not going to have you on the clock when you are off the property. So the answer to your question is no. |

You need to file a workmens comp claim. Or discuss with HR department, they may decide to pay you and avoide their claims rates going up. |

you should def consult a lawyer...esp if you got hurt AT and DURING work - they shouldnt be able to refuse your pay. Isnt that covered under workers comp? |

Contact your state office that deals with wages and hours. Sometimes it's called "Wages and Hours." That would be free. Then you'll know if you should contact attorney. |

It's legitimate. Your lawyer will find out whether or not the injury is through fault of your own, and jurisdict whether or not charges should be pressed. |

You weren't perfoming your job duties so why would you get paid? If you have vacation or sick time saved, use that to obtain the pay you missed out on. |

As a general rule, you should have gotten paid for the time you spent in the hospital as you were injured on the job. I would talk to an attorney, however, make sure to find an attorney who will offer you a free consultation. I don't know what state you are from, but if you need help finding an attorney contact your state's legal local bar and they should be able to recommend an attorney that handles this type of thing.
Also, contact your local labor board and find out if you can file a claim with them for lost wages. Hope everything works out and good luck. |

You definitely should call a lawyer, your company sounds cruel. How serious is your injury? You might get compensation as well. Nowadays there are free consultations, some law firms open 24 hours a day. Read your local newspaper or do a search on internet. |
