Have you ever filed a complaint (with employer, or outside agency) for retaliation or discrimination - with emphasis that company polices are only being enforced on YOU, and although the same situation applies to many others, only YOU have been "disciplined"?

Or for retaliation, if perhaps you questioned an "age" discriminatory policy, didnt get a good answer from the boss, contacted HR, and then got "discplined" almost immediately afterward for a policy that has never been enforced previously, or is ONLY being enforced on YOU?

You shouldnt be disciplined for these actions. Seems to me followed the right steps. You should contact your corporate or home office about this. Your company should have an 'Open Door Policy', meaning that you can go talk to whomever you like, without the fear of retaliation.

Yes, I did file an EOC complaint based on age. I was going to apply for a supervisory position. Within just a few weeks, I was offered a part-time position. This was not economically feasible for me to accept. It was also after I had been in an accident on company time. I was let go by the company. EOC said that my "equals" were being treated the same but not true. Didn't fight it because lawyers would have cost too much.

yes twice, don't be afraid to stand up for your self regardless of the outcome, they will learn that you are not a fool.

It's all in the way you file a complaint with your HR Dept.

My advice is instead of verbally going to them write a letter about the situation and send it in the mail "Certified" (this way you have proof that they received it). They have to get with you right away it is the law. Each time you have a problem send it this way and make sure you document the conversations you have with anyone concerning the issues. If they fire you for the things you complained about then you may have the right to sue the company. But please consult a lawyer first before taking any legal action.

Yes, this exact thing happened to me. I filed a claim and was retialiated against for three years. I work for a large bank and they could care less.

Look for a new job, because it does not end. I got canned after 10 years with the employer and added value. I was the number one in my area in client retention and sales. So even producing revenue did not stop the cease firing!!!!!

Yes, I just got a determination that I was eligible for unemployment benefits from the Department of Labor. Here is what the determination was: "You were discharged for violation of a company rule; you were either unaware of the rule, or the rule was not reasonable or not uniformly enforced. A disregard of the employer's interests has not been established." The employer has 15 days to appeal. If they appeal, I will go to a hearing. If they do not, I will be headed to the Equal Employment Opportunity Commission to file a complaint of sexual harassment, age discrimination and retaliation for my participation in a protected activity. (I filed a complaint about improper behavior in a call center where a supervisor was discharged and another employee suspended. The one who was suspended was promoted to a position in HR and was in the room when I was wrongfully discharged.) Sounds like you have a similar situation to mine. Stand up for yourself and make your complaint as detailed as possible. If you still have not been dismissed, I would go straight to the EEOC and file a complaint. They can't do anything to you because you have now engaged in what they call a "protected activity." There is hope for employees, the problem is that most are to afraid to stand up for themselves or other for fear of job loss. It's lamentable, but if enough people would stand up for their rights, more employers would be forced into complying with fair labor practices. Good luck!
