How can I rent or give to a neighbor some of my garden?
i and my wife are getting old and find the garden too large to manage we don`t want to sell for building and a neighbour is asking to use part of it.

Tell them you'd love for them to use the space so long as they help you with managing the whole thing in return (BARTER is GOOD!). You get the help you need, they get the space they want. Win-win.

If they are asking to use it then the procedure is simple you can ask them to pay for their use, negiotiate a reasonable rent per week.

This is really NOT as difficult as it seems.
You can actually WRITE UP a very simple AGREEMENT for usage.

Due to PROPERTY RIGHTS, you do NOT want to GIVE OR SELL a piece of your PERSONAL PROPERTY because it AFFECTS your PROPERTY VALUE....and your PROPERTY TAXES.

If you wish to SELL or GIVE a piece of your property to your neighbor, you will have to do it LEGALLY and file the SELL with the PROPER AUTHORITIES...which of course has to be on PUBLIC RECORD. You may sell that particular piece of property for as little as $1.00. But for PROPERTY TAX purposes it has to be done LEGALLY.

For simple usage of your property all you have to do is write out an agreement that your neighbor has the right to use the so-and-so portion of your property for a GARDEN ONLY. And that the agreement will be discontinued upon the SELL, the TRANSFER of OWNERSHIP, the RELOCATION of the OWNERS, DEATH, or that the OWNERS are UNABLE TO COMPETENTLY CONTINUE TO AGREE TO THE MUTUAL USAGE OF THE PROPERTY.

If you have children that will one day inherit your property you might wish to discuss with them that you have allowed your neighbor to use part of your property for his garden with a written agreement and you wish for them to abide by your wishes for as long as they can allow it.

That's it! Sounds like it's gonna be one heck of a garden! Best of luck!

just throw your weeds over the fence that way they get some of your garden and it saves you carting them about problem solved!

beware if you do this you need to tell the taxman as they will want you to declare the income from the rent.

I would also involve a solicitor so everything is covered legally.

so let them use it, what do you want a medal or a chest to pin it on, or do you want money for it? it's only temporary, and I am sure you will get or use some of it, so whats the problem putting all of this thought into it?

Though it may be tempting to just go without a contract or lease agreement, I wouldn't go that route.

Nip to your local Stationary store or bookshop as "Lawpack" do some really good pre-made contracts for just such a thing. Saves on the expense of a lawyer.

Better make sure you have a lawyer draw up a contract as we have been ripped by family members on such things.You need a liability release for your sake.
