Yes, they should've been packaged and sent in a freezer lorry or whatever and got to you as ice cubes, unless the seller said they might melt.
It's not as described and so a violation of the agreement.

besides the fact you bought ICE overe ebay, if they said they would be frozen when they arrived, i wuld ask for a refund, otherwise forget about
