barney | I have paid a deposit for a vehicle,now the firm keep putting me off collecting it,can i retrieve my deposit? |
as said before,i paid a 50% deposit for a van.the company are putting 12 months mot on it,so the vehicle would'nt be ready for 4 days.since,they have put me off twice,saying the vehicle still was'nt ready .Now,i am supposed to pick the vehicle up tomorrow,what if they put me off again! Am i within my Rights to ask for my deposit back? |

If it is over the four days they said at first then yes you can get deposit back.They have broken the contract they had with you and legally they are obliged to return deposit |

OK here is the skinny,I'm a previous car dealer!
If the deposit was on the vehicle and the agreement was for them to make repairs before you picked the vehicle up?
Then no, legally they can keep your deposit! But there is two things, they can only keep the amount of which they spent on repairs for that vehicle.The second thing is time it has to be reasonable other wise they have two choices,#1 give your money back completely or give you a rental paid by them until the vehicle is ready! I would tell them to give your cash back or give you a rental van at there expense. But if you have already owned the van for 12 months this becomes a warranty issue not a deposit issue.

Yes go in in the morning to collect the vehicle as aranged. if they do not have it ready ask for your deposit back, or I would ask for a discount on the final payment as you have been messed around. |

A deposit is just that...a deposit.
You can try to get it back but don't hold your breath.
If they put you off this time ask for it to be put into writing (including the reason and the ate of the initial deposit) and signed by the manager.
If they do this and tell you to go back again, do it again!
Then you have reason to seek legal advice. |

Yes you can ask for your deposit back, they may deduct some money saying that it is to pay for administration. However as it is a used van and they are taking this much time I would start to worry! If you are a member of the AA or RAC ask them to come and check it over before you move it. It will cost you but it will be worth it. If you aren't a member get a qualified mechanic to do a thorough check. You can also go to your local Trading Standards office. |
