I have today received a letter for a debt I had forgotton about..do I have to pay?
The debt relates to August 2004 and is for £1080. I know it is within 6 years so they legally are entitled to have it back. However the debt has been sold from Braclays to debt management agency who have added interest and charges on since 2004. The balance was only approx £700 until added extras.
I am happy to pay as I owe it, but is it worth making them an low offer first like 20% of balance etc and haggle with them or just pay it back?

I'd ask the Citizens Advice Bureau for help, if I was in your situation. They frequently help mediate between the public and companies that they owe money to, often achieving a reduced amount to be paid or freezing of intererest and further charges, if paying back over a period of time, rather than all at once. They will telephone and write on your behalf, again saving you some money. It's best to follow this up immediately, so that the situation doesn't deteriorate any more, as well as this showing that you are attempting to settle with them.

Before you go to the CAB, work out what you could afford to pay - lump sum, and/or every month, as this will help them to discuss your offer with the agency/Barclays. Allowing someone else to do the talking will also take some pressure off from you, which I would appreciate, if I was in your situation.

Hope this helps. Good luck! Rob

it looks like you are liable for the debt as you say but im sure its worth making them an offer.

Haggle first, but if they want they'll get the whole lot back *plus* additional costs.

How do you "forget" about a £700 debt?

Debt agencies are a complete pain in the bottom, your best bet is to contact them, they will probably demand a income/expenditure statement from you, as they need to see you are paying as much as you can afford to them.

make an offer of a monthly payment .. see if it is accepted.
It is always best to be honest with them .. they tend to be more accomodating.

Debt management agencies only exist, because of the belief that if you ignore the debt long enough it will simply go away.

So, they left you alone... for years... giving you enough time to forget the debt ever existed... All the while they're compounding interest, tacking on fees, and biding their time until the calculated moment arrived... and just when you were comfortably confident that all was well... Out of nowhere they returned ... with a surprise of their own.

offering a settlement is a good idea, either way they are going to keep it on your credit record.

you will have to eventually pay it so you might as well pay it now before they put more interest on it

You can try haggling, it's always worth a try, Ihave heard of people successfully knocking half the debt off. If you say you can either pay £400 total now or the full amount in £20 per month installments, it then depends on their company policy whether they want to wait for it all or have the lump sum now.

Your 'chill out' attitude is what got you into this mess!!

I would wait, for another month, and then phone them up. Explain that you cannot afford this payment. They will prob offer you up to 50% off the bill anyway if you play it totally cool.

Remember that this will not affect your credit rating anymore, as the account has been frozen.

Just push it until they send you one about getting a CCJ, then talk business with them.

I'm schocked you have asked the question. Of course you have to pay. Its your debt, plus how can you forget that you owed that amount of money.
They can and will take you to court if you dont pay. So cough up.
