I let someone borrow $3000 dollars about 3 years ago and I haven't seen a dime of it.?
All we signed was a peice of paper that said that I was letting them borrow that money and that they were to pay me back. Since it was been 3 years is there anything that I can do to get them to pay or am I screwed? I don't know where they live now all I have is a cell phone number.

madmilker
jus ....write it off!.........they needed the money and you let them have it........case close!

they are the ones having to live with the fact......they haven't paid you back...........and you only live with the fact......your out $3000!
and they needed the money.

Try the small claims court.Do you have the dollar amount?Make sure you make copys of your piece of paper. The small claims court might help you find his address.

Just get the judge involved.

Do not ever do business or loan money to friends.

ELIZY
first of all when giving money...never lend it! either give it away or keep it for your self letting someone borrow money always ends the same way...so you have a piece of paper well hunt ole dummy down and then take them to court...why has it taken you 3 years? well i dont think time is an issue so sue the #@%$ out of this person and get your money back and most of all LEARN A LESSON!!!

You can sue them in small claims court. Why did you wait so long to try and collect? Is this person going to try and make it sound like it was a gift?

Judge Judy...it you get on that show I beleive they pay off the judgment if the judge finds in your favor. However, then your personal business is out there on national TV...

Did you have the signatures on the original contract notarized? Otherwise it may be tough to prove that the contract is valid. What were the terms of repayment - when was the money supposed to be paid back? You may have to hire an investigator to track your lendee down to serve him with a lawsuit. That's your only hope of getting any money back at this point.

newyorkgal71
Get an attorney to write a letter requesting immediate repayment.

gypsygirl731
if it wasnt notorized then your out of luck theres a statue of limitations as well to make small claims court processing as well. might be past limit so ya lost already.. i wouldve suggested that you had witnesses notoriazation etc and some kind fo collateral. Call a lawyer for a free consultation

jackielathon
There's isn't much that can be done unless you find the person and you still have the piece of paper. Maybe you all can go to small claims court and you can get your money back. But if not
live by this rule never lend out if you can't afford to lose it. Don't
ever give or loan and expect it come back to you because it's just like giving and a gift come from the heart& you shouldn't expect anything back. There is a blessing in giving!

I'm not sure of the laws regarding this where you live but I would do my best to try and call them first (be nice and give them a chance to redeem themselves but set a time limit), if you get blown off then call a lawyer (I'm sure there are some out there that only "collect" if you do). Unfortunately the quickest way to truly know someone or lose a friend is to lend them money or move in with them.
I feel bad for you, I think we all pretty much have been in your shoes, maybe not for that large of an amount, but I think we can all sympathize.

You are not first one to face this and not the last. I don't feel you will see the money again, unless your state has laws that protect the piece of paper that you mentioned, but the attorney fees may exceed the cost of your originaly loan.
