I was charge twice for the same suit. Can they really do that? How long do they have to refund my money?
I bought a suit at New York & Company and while the cashier was processing my order, the register froze up. I had already signed my check and she was going to process it electronically. Well, after the register froze up, she moved me to a second register. At that register she proceeded to ring me up. This time she said my check had to be "deposited only." Well, three days later and checked my bank statement and I noticed that I was charged twice (same check number, amount and payee). The only difference was one was an electronic check and the other was a regular check . This occured on 10/23/07. I have faxed my bank statement a total of 3 times. I have called customer service sooo many times. Is this legal??? What are my options?

For everyone who said, "Go back to the store..." Did that. I went back to the store and was directed to call customer service. Called customer service and faxed my bank statement 3 times.

Have you tried calling your bank? Surely they can do something if it's the same check number, amount and payee and you tell them what happened.

If the bank can't intervene, call and ask for a supervisor. When they say they can help you tell them no, you want a supervisor and don't back down. They have to let you talk to one. Then explain calmly what has happened, how disappointed you are since you've either had good luck with this company , and say that you expect this to be remedied TODAY since nearly a month has passed. Say you also think a gift certificate of some sort would be nice since you've had to call so many times. Make sure you write down the name of anyone you talk to and the date and time. If nothing happens by the NEXT DAY call back and ask for the supervisor's supervisor and tell him/her that if it is not remedied you will contact the Better Business Bureau (and do this if they don't hold up their end of the bargain). Stay polite. Ask for compensation for your trouble in the form of a gift certificate. Tell them that you're really disappointed in their company and have told dozens of people about this, which is a shame since word of mouth is so important to companies (they hate when you say that). Ask for the corporate address and the name of the president of the company and write to him/her if things don't get resolved. It's amazing how they scramble when the muckety-mucks get involved. Good luck.

You could put a stop on the other check or do it the easier way, go to the store and have them refund your money and talk to the manager. Most stores its 30 days you have to return the item, but you should most definitely go to the store and talk to a manger and then go talk to your bank in person

I suspect you need to contact someone higher in that company, like maybe headquarters and the president's office and have them either solve it or forward your call to the person who will. In the meantime write them a letter and send a copy to your bank. Customer service never turns me on, I always have to go higher. What's legal is you should get your money back.

I would try going back to the store first, they should have some type of policy for this type of situation. (I hate when they automatically do a draft with your check). Its like you really wasted a check. Had you used a debit card, your bank might be a little more willing to help you since most are backed by MC or Visa.

No, it was an improper transaction. Instead of faxing your statement again, start by organizing your records and make a call to the office of the president of the company. Don't demand to speak to the president, but ask politely and write down the name and title of the person to whom you talk. Explain that you have talked several times to customer service and have not gotten an acceptable response and then (or when asked) explain what happened in the store.
You should also contact the bank and put them on notice.
This is, by the way, one reason for paying with a credit card. If you had done so, instead of arguing this yourself, the credit card company would have blocked the double payment and argued for you.

Well, what you could do is go down to the store that you have bought the suit from ask to speak to the manager or the boss, but make sure that you have the suit, a copy of the check that was made that day and the recite of purchase for the suit and explain what happened. They should be able to do something to fix the problem. But make sure you get the name of the person in which you talked with about the problem just in case the problem does not get solved you have something just in case you need to take any action to get the results that you are looking for.

Yes, it is illegal. You should take your receipt to the bank, tell them what happened and they should fix it on their end. Ask for a manager if all else fails.

No, its not legal. I would go back to the store with a copy of your bank statement and your receipt. Ask for the manager and explain the situation to them, they should take care of it for you. If not you can go to your bank and explain it and they will handle it for you.

Of course it's not legal. Call your credit card company and explain. They can probably check and verify it with the suit company.

Just 'cause they've got a glitchy system doesn't mean you have to pay twice.
