What's Your Problem?
If someone punches you in the face and you have no witnesses, what are your legal remedies?
I'm interested to find out whether there are any legal recourse (kinda difficult since no witness). If not, would you recommend hitting back? And legally, how does "self defence" work?

Photos make sense. But even if you can prove that you're hurt, how do you prove it is he who hit you? One of you suggested matching you bruise with his fist size? Is that sufficient and conclusive evidence?

And with regards to self-defence? I think you're only able to use a certain level of force to "defend" yourself. Where is the limit? E.g. I'm sure you're not allowed to hit him with a baseball bat as "self defence".

Just curious since I was often bullied in school when I was younger. I'm trained in Tae Kwon Do, so I hit back at times... and they stop... but I'm just thinking how I would deal with the situation now if it happened, as an adult.

First take pictures of your injuries (if you have any) before they heal. Then, think about the situation. Have you had problems with this person before? If so, you must have had someone around to see what was going. That is now your witness. Next, you need to report this to the police and make a record to protect yourself in the future. They willprobably not go after the person now but they can if something happens later. And last. DO NOT go out and seek revenge onw your own. That will only get you in trouble. So many time you hear about these things and the bad guys always gets off as the victim. So don't even think about it. NOTE: You need to consider how bad this event was. I mean if this is just one of those things then the whole police report might be going too far. If you walk around in fear then report it right away. There is not much else you can do besides what I've told you. In court it will be his word against yours. So follow my advise and be ready for the next time. Good luck.

As the saying goes, "Two wrongs don't make a right."

If you feel that your safety or life are in immediate danger, you can protect yourself. However, if you want to hit back just so you can take revenge on your assailant, think again. You might regret it in the morning. Be the bigger person and just walk away if possible. Or, better yet, get out of there before the fight starts, if you can.

Take pictures and visit a doctor if you are trying to make a case against that person.

If he was the only one throwing punches I would expect that you are wounded in some way. The wounds can help your case. Mayebe a mark on your face matches his fist.

you can press achrges without a witness, but you shoudl have some sort of evidence. a bruise or mark form being hit,. it boils down to your word against the opther party. as for legal remedeis none if you dont press charges. Hitting back is only worth it, if you value your pride or ego. You dont want to end up in the same position as the person you are considering pressing charges against.

Yeah I guess it is. I'm not sure how self defense works in America. I don't live there. In Australia, When someone takes you, my understanding is you can strike back, with necessary force. (I'm not sure exactly - don't take this answer as an insight into my country's crazy legal system). Anyway, people will hit other people when they know there is no one else around. If you can sue someone for assault, and win, you'll probably put a stop to cowardly attacks like that forever.

Take a photo and write down the time action and reason then take it to the police and write a formal statement. The police will question you and the offender. They will take it into their own hands and only charge the person if they feel the violence was not provoked. If they can-not decide they will take it to court for trial.

There's nothing you can do unless you have proof on your face or a non-prejudice judge...trust me hit the ***** back. Plus if he hits you first and is over 18 years old, you have every right to kick his ***

First of all, imediately after being hit you should call the police, IMMEDIATELY. Second, (if you have insurance) go to the hospital er and have a medical professional document the findings on your face. This will rpove invaluable if you ever do go to trial. Remember, there are two different kinds of trial at play here, both criminal and civil and all the evidence possible will help in both cases. (By the way, if someone hits you in the face and it doesn't leave any evidence, then he didn't really hit you, which negates the picture taking technique as well.) Lastly, if you're both men, and noone else is around, and it's just you versus him, than may the best man win. If you lose, take your lickin and shove on.
