If they send you the money back that means they are not agreeing to the payment of 10.00 a week. They can turn you over to collections but can also fight it with your attempt to pay. If they have kept any of the money then they have agreed to whatever you sent them.

Yes, they can send anyone to collections. $10 a week may not be close to what the cost was. But the doctor's office has a right to charge, and demand payment n their terms. |

Do you mean they're not even cashing your checks because they evidently don't think you're paying enough? Yes, they can probably turn your account over to a collection agency, but it wouldn't really be to their advantage to do so. The agency takes a big bite out of the amount collected as its commission or fee, so a bill turned over to one doesn't get paid in full to the payee. I would suggest that you write to the doctor's office (and maybe to the doctor him/herself as well as the office staff) explaining that you're paying as much as you can and will pay in full if they will just be patient, and enclose the checks they've sent back to you. You might also say specifically that there is no need to complicate matters by bringing in a collection agency, for the reason you've just given. If they do, however, be prepared to tell the agency the same thing. I trust, too, that you have either an answering machine or Caller ID. Incidentally, I believe that it's illegal for such an agency to call you at work, much less to call your employer, although this aspect of the situation may vary from one state to another. |

check the amount of medical bills and try to have insurance co pay more. also increase $10 to $20. |

They do not have to accept your payment. Call them and explain your situation and try to work something out. That's the best you can do. |

From what I have read, they can demand payment in full at any time and send you to collections if you don't pay it. They can even accept partial payments for a while, then decide they want payment in full. Call and talk to the doctor's office and see if you can't work something out. Perhaps no agreement was sent up and this person has just been sending $10 a week with no explanation to them? I can't see why an office would really want to do this if they are getting steady money. Maybe an agreement could be reached at a higher amount per week, $15 or $20. |

no, But they will "threaten".. but by law as long as you are sending a payment of some sort they cannot send you to collections. Just make sure you keep a record of what you are sending |

Yes of course they can still turn you over for collections. The balance is due in full at time of service. If they gave you time to pay, then that time is over. Either pay it in full now or make a new payment arrangement or they can send it for collections and or legal action.
EDIT: Pay no attention to the uninformed person who wrongfully "CLAIMS" they can do nothing by law. We sued and won against some who thought that as well. Your best bet is to call them and see if a new payment plan is OK or pay it off somehow. They do NOT have to accept your payments nor is a past acceptance of same payment make a bit of difference especially if you missed any payments. The only thing is, if you had a payment agreement and kept it, then they are legally bound to continue as long as you kept your end of the bargain. If you missed or were late with any payments, then the agreement was broken by you and they can no longer be held to their end of things.
Jcuriel has no clue what he is talking about either when he claimed because they refused payment you do not have to pay them legally. I have never heard such misinformed BS in my life. Just call the docs office and see what can be worked out in regards to payments. Be polite, if the clerk you speak to is not helpful or nice, ask for their supervisor. Always be polite and tell them what is happening in your life financially that prevents payment in full. Good luck. |

They can turn you over to collections any time they like. Most of the people who run the billing are mind dead anyways, relying on computers. Person to person contact is non existent.
Have you called them to find out why they will not except your payment? |

in some state if they send you your money back it is considered paid in full. Also, some states don't allow debts to be called on on Sundays I'd check into it. |

Um...TECHNICALLY...since they have refused the cheques... You are no-longer legally required to continue paying them on that debt.
However, speak to a lawyer FAST! (Most reputable lawyers will allow you an initial consult for free.) Also, whatever you do...DO.NOT.LOOSE.THOSE.CHEQUES!!! (And keep the letter as well.) Also, keep your options open, and if necessary, report the doctor to the local BBB and College of Physicians and Surgeons!
Please note, that whatever else happens, you will likely have lost the right to use that doctor in future. |

They cant refuse a payment.. as long as you are paying it.
Did ya call them and ask? or did you set up the payment plan with them? Still possible to go to collections.

I don't belive that they can turn it over for collections, you are making payments on it and at what sounds like a rate that you can afford. If I was the Dr I would rather have $10 a week for a year than no money and hope that collections could get me some money. I would call the Dr and make sure they realize that you are attempting to make payments and ask to be on a payment plan, that is assuming that you are not on a payment plan already. |

Oh hell yes. Now, when it comes out that you are cleared and have already paid up they will return your money, but by that time your checque will have been in their bank account accumulating interest. They keep the interest but return the base amount. Thereby making money on your money. So they don't lose. |
