Appartently yes, we asked the bank if I wrote a cheque for 1 million and asked my cousin to cash it what would happen, they said they would probably prosecute for fraud... worth asking though

Yes, but if every person who wrote a bad check went to jail, half the population of the US would be incarcerated since a lot of people just can't balance a checkbook. You are given a chance to make the check good.

Strictly speaking it is illegal. Whether the bank would do anything about it depends on whether they think they are likely to get their money.

If the intent is to defraud, then yes.

Unfortunately you have used the operative words "knowing that insufficient funds are available" so the answer is yes it is an offence and there is the "intent to defraud" which is not a civil offence it's a criminal offence which again depending on the mood of the court (if it went that far) you coulld go to prison.

It depends on what your intentions are. If you intend on replacing the funds then no.
Anyother intentions then yes i think it is illegal.
It happens everyday though.
Try over draft protection instead.
