Tania R | Is it legal for an employer to demand extended work hours even if it affects your child? |
my employer wants to change our hour till 6 pm and i have no one to get my child from day care which closes at 6 pm |

Your employer does not have to take your family needs into consideration. You now have a choice: Find a new day care or find a new job. |

Most likely, yes it is legal. Exceptions to this would be if you have a specific contract that states other times of work or if you work for a union company (then schedule changes may have to be approved by the union). Employers are normally allowed to set schedules, specific work duties and pay rates. If you have not already, I would explain to your employer the difficulty and see if they can come up with a reasonable compromise. When you speak to them, come at it from the point of view that you really do want to work and want to figure out a way to make their needs for people to be there co-exist with your need to pick up your kids. Maybe they can offer a different idea. |

considering this is the US, if there is no employment contract or union contract, your employer can change your hours, your pay and your benifets. It does not matter who or what it effects, you are expected to change your personal life to work around your work.
( not fair, not right but legal) |

Your employer does not have to take your home situation into account when changing your job description (in the U.S.). If you have any question as to your rights in this case, call your local Employment Commission - they can answer all of your questions and then you'll know what recourse you have, if any. |

Yes. Unless you have a contract specifying your hours. The employer hired you, not your child, and if you cannot do the job that the employer demands of you, you will loose your job. |

It is, sadly, legal. Make an arangement with the teacher to pay her to wait a little bit or sometrhing. If you live far from it, transfer to another day care. |

Sad to say its legal. If you are working overtime because of it I hope you're making sure to get paid overtime rates. They can't beat you out of that at least.
It looks like you either have to change your job, change your day care, or find someone to pick up your child. Good luck. |

You would have to call the labor board in your state to find out the laws on manitory overtime. I now that in my state they have to give you a paper stating there will be manitory overtime and you have to sign it. Otherwise if you do not recieve a paper like this you can refuse to work overtime and legal can not be fired for it. |

Im guessing your child is an infant, no? And I'm guessing that you're less than 20 years old, right? You've got NO rights, sister! The next time you choose to spread 'em, think about it. Demand my ***, your child is YOUR responsibility, NOT MINE. Your're on your own. Take care, sweetheart. |

I would recommend discussing the issue with your employer. Can you come in an hour early? I don't see why a compromise cannot be reached.
I would recommend you talk to your state's human resource department or labor agency for more information. You could also speak with the US Department of Labor.
Try to work it out before resorting to other measures such as a flat out no. Have they actually told you it doesn't matter if you have to pick up your child from day care? If not, ask if you can keep your shift time because of special circumstances. |
