Is it legal to make salaried employees work more than 40 hrs a week without flex time or some other benifit?
I am a full time staff on salary. I am made to work more than 40 hours a week at my job. When I was hired I was told that the company didn't offer overtime, but that if I had to work more than 40 hours a week that I would be able to flex my time out (like say I stay late on Monday then can leave early the next day). However, my boss does not honor this and I am having to work many more hours than this for nothing. I wouldn't mind if it was on a project or something, but half the time when he makes me work over the 40 hours I am really doing nothing. The policy I was told about flexing my time was verbal. What can I do about this?

Salaried people are exempt from overtime. You're only option is to find a better job and quit.

I was going through the same thing. I do not work on salary, I get paid hourly, however, I started working 40 hrs a week.. then slowly.. I started doing 50. It was veryy exhausting.. so I decided to ask for "time and a half" . That was decline.. so surely.. I went back down to 40 hrs.. and I am fine with that. I feel you should definelty voice your opinion.. and stand up for yourself. Not in a nasty way, however, let them understand how you feel. You must bring up the "verbal " policy or agreement that you understood. Good luck.

Depends on the state (texas?) you live in. You REALLY need to see an attorney, in your jurisdiction. For instance in California, employees are considered "at will". And without a contract otherwise, can quit and be fired without notice or penalty. So, if you don't like what is going on, you need to find out your rights by asking a lawyer, and bring all paperwork you have signed, including your employment contract, if you have one.

NOTE:::::: The laws regarding employment differ from STATE to STATE.

ALSO NOTE:::: VERBAL means NOTHING. Don't listen to that line of baloney. Even if a court considered it, it's the company against you. Most Judges are biased towards companies, because they tend to be or have been self-employed, as attorneys, and understand the demands of Business-Ownership. Owning and running a company is VERY expensive.

Wow. That's too bad that you don't have the policy in writing.
1) Keep track of all hours worked, cover yourself if you spend a lot of time fooling around!
2) Talk to the boss about the hours & flex time. Remind him of your verbal agreement.
3) If it continues to be a problem, go to HR & let the boss know that you plan to do that if he can't honor his agreement with you.
4) Be prepared for a mad boss.

If it is your boss, then call head of personnel at your company. Check your contract also. Verbal is binding. Your boss represents the company.

Confront him, if he has "no idea what your talking about" than maybe you could sue, just maybe. Unless you really REALLY love this job, the best option for you is to quit.

As soon as you are put on a salary paid position you are exempt from over time. Of course they don't offer overtime because you are salary...you don't get paid hrly anymore so they can ask you to work how ever long they want and there's nothing legally you can do about it. It sucks but being put on salary pays the price of loving your job. If you don't love your job then I suggest you find another one. Good luck!

Its not illegal! I have to work many extra hours on projects and do it 'for the love of it'. The law now states a maximum 48 hour working week. Once you have completed 48 hours during the week, you are, by law, entitled to go home. Visit this link and show it to your boss!
