a lady bought something from me and i was nice enough to let her write me a check because i like to think the best of people and to my dissmay the b**** canceled the check and i was ripped off for $60 plus a $5 check cancelation fee from my bank. i looked into sueing in small claims court but there is a $30 fee to file and i assume it would be a lengthy and time consuming process. would you do it? is it really worth it? |

First call the number on the check and request the item back.
Or inform her that legal action will be taken, including court plus costs if needed.
Only then is it worth going to court, plus you can inform the judge you offered to take the item back at a 5 dollar loss for the cancelled check.
I would bring the person to court on principle of theft and bad checks. The Judge would back you up, however if the person is a deadbeat you may not get your money back, but she will end up with a record. And that may save someone else down the line, after the bank shuts her down for bad checks. |

Go for it. A lot of people pay on just receiving the court papers. And if you do make it court you can ad on the costs of missing work and paying that fee to amount you are suing for. |

Besides! It is more about not letting injustice happen to you than about the money!

First, if you live in the US, you don't need small claims court. Just hand the check over to your local District Attorneys office. The she did is a crime. It won't cost you a thing.
IF you decide to go to small claims court, it is usably a fairly quick process. In most states you have to represent yourself.
I would say go for it, she probably makes a habit of it.
Also you might call both your bank and her bank. See if they have a way of helping. |
