Is the manager of a restaurant who is paid a salary allowed to wait on tables and accept tips?

Additional Details
The person is not an owner. They said they need to make $900 extra by the end of the month & will do the work of a waitress to make the additional money while still getting manager pay.

Of course he is.

He is also "allowed" to pay taxes on the tips.

uncle billy
sure

dukalink6000
If he performs the service, yes

keith s
yes

Richmond C
Depends on the resturant SOP's. If yes they have to be included in their income statement at the end of the year.

AndyMan
If he actually waits on someone, he can. Also, its his returant, he can do whatever he wants. It doesn't seem fair to the waitresses and waiters though, they get paid way less than him.

Hello:
In my opinion, if he wants to help out and wait on tables when the workers are busy that makes him a good manager, but i would have a big problem if he is taking tips.
The reason he is on salary is because he is earning a larger amount of money to make sure the restaurant is running smooth. Being in a manager position, he could pick and choose who he wants to serve and thereby taking money out of the hands of the hard working waiters and waitress's.
I do not know if tips are kept by the person looking after the table or the tips are collected at night and then split evenly.
Either way, i don't think he is allowed to take tips. the best thing to do is to ask his boss as he might not even know about this practise going on.

Yes. But it is up to that company's policy.

rrrevils
Yes, but hopefully he is doing so when another person is truly needed to take care of customers. However, this manager should not accept the tips. They should be rolled to the station he covered. Now, if he is covering a whole shift for someone absent, that is another matter.

chefyoma
Not usually. its not his or her job to wait on tables.

Quite a number of people touch on a variety of aspects of this.

I'm going to assume that your statement is correct, that the person in question is a Manager, not an owner. The manager should assist with whatever areas the restaurant require assistance, if that means helping with a few tables then do it, if it means bussing the tables to clear them quicker then do it, if it means playing the role of Host or cashier or whatever, they should do whatever is needed to keep the restaurant operating well. But if tips are generated from what he is doing he probably should put them in the pool for the waiters/bus staff.

Now if it is a small restaurant and the manager needs to wait tables as a specific part of his responsibilities then technically he should get tips, but I would tip at a lower level if I was positive he was getting a normal salary as his base pay.

they are allowed to help wait on tables but the tips should go to the waiters or waitresses

Bistro
unless he owns the place. Otherwise, I would say no.

Yes, but he must claim the tips as income!!

cliffy
of course not.

your subordinates are the waiters and you are not to take their potential tips.. if you do, you are their direct competitor and not supervisor. it is called conflict of interest.
