Yes, its legal. Resend the time sheets; make copies. Hand it in directly to a supervisor have them to sign your copies telling them that it was submitted and this is just proof that it's been received for your records. From now on, keep signed copies, you should have no more problems. If nobody wants to sign, then keep a log of when you dropped it off/ whom received it/time and date. Any more discrepancies take it up with the Labor Department of your City/Town/Providence. They will straighten up and fly right then. Good Luck! |

Do you have copies of the time sheet? Get someone you worked with for that week (preferably a supervisor/manager) to confirm that you worked the hours you are due to be paid for, you can write it up yourself, have it witnessed and if there are still problems then go to the employment tribunal for advice. |

No, they must pay you when the company pay day is. If somehow your time sheets were not for that pay period than yes they can. But if the pay period covers any of the hours you worked they HAVE to pay you.

If they never received the required time sheets, they can withhold pay as they would have no idea how many hours you worked or when.
If your employer says they didn't receive them, simply resend them! |

First, send them in again. Be sure to state that it is the second time you've submitted them, and keep a record of when and how you sent them.
If they still do not pay you, you will need to find a lawyer who specializes in workplace grievances.
In the future, always document that you have sent your timecard. Keep a copy of the email or fax. If you mail them, keep copies with the date mailed written on them. |

I would resend the time sheets by recorded delivery. With them include a letter stating that unless full payment of your wages is made within 10 working days you will commence proceedings in the small claims court to recover this amount and any subsequent expense accrued in enforcing your legal rights. |

Call the HR department. Send your time sheets in again, and notify HR so they can track it.
It is most likely just a glitch, or they are still on your bosses desk. |

Can an employer legally withold wages for someone they can't prove actually worked? Sure why would they pay someone if they didn't hand in their timesheets? |
