EV | Let's say your paycheck got messed up by your employer....? |
.... and your bank account went negative because of the lack of money due to your employer's screw-up--- would it be appropriate to demand that they pay the overdraft fees? Additional Details This is assuming you weren't overdrafted previously, and that you knew you had bills automatically coming out because you had PLANNED the payments around your payday. |

It's ultimately your responsibility to confirm deposit of funds. But it wouldn't hurt to ask your employer if they'll reimburse you -- maybe they'll feel guilty and do it. |

When I discussed the difference in the paycheck with my employer, I would mention what happened and (just in case) have evidence of it to show your employer. Ask politely and see what comes of it.
I put a deposit in an overnight box at our bank once in order to cover sn automatic payment I knew would come out that day. The deposit was left in the box and I was not credited until the next day. I had four items marked NSF. When I contacted the bank about it, they refunded my account all of the NSF charges. It never hurts to ask.
EDIT: After reading your additional explanation, yes, you have every right to ask for those charges to be refunded...ESPECIALLY if you are not commissioned and know what your pay is before you receive it! |

You could try but that would be difficult. It is YOUR responsibility to ensure you do not write checks or automatic payments using funds not in your account. You are wholly responsible to ensure you maintain a sufficient balance. |

I work at a bank.. and I think the bank will tell you that it is your fault for having automatic withdraws in your account and not having the money definitely in there. It sounds unfair, I know. I would definitely demand that they (your employer) re-pay you for the overdraft fees. It would not be the banks responsiblity. Although, if you were to come to my bank my manager would probably approve for the bank to refund the money.. especially if it were your first overdraft. Call your bank, explain to them your situation & go from there.
hope this helps ya. good luck! |

Sometimes the bank itself will reverse the charges if you get a statement from the employer. Especially on direct deposit, this is a possibility. Depends on the bank and the branch. I would talk to them first. |

i have had this problem before and what i did was go talk to the bank most times they will work with you they took care of alll my charges. so go talk to them they might take care of all or maybe some of it. most banks will take care of atleast half good luck |

i definitely think you have the right to ask for overdrafts if it was soley the employers fault... you shouldnt have to pay for their mistake... this was in no way your fault, as you only set up the auto payments knowing you would have the money in there at that time.... since it was the employer who messed up, the money wasnt there. if this was your first overdraft experience, you could talk to the bank and they will prolly refund the over draft charges... but if it isnt your first overdraft, they may still do that if you havnt been overdraft very many times depending on how long you have had the acct. there.... i would talk to the employer, if the didnt help, i would talk to the bank..
i would just tell the employer politely: "hey. i noticed a mistake was made with my check this week becasue of a # error on behalf of the company, and i have auto drafts come out every month, around pay time. i was charged overdraft fees for this mistake. is there anyway the company could reimburse these fees for me. and if not, could the company at least reinburse me half of the fees?" |

Hey EM. missed ya lately at r/s. Their fault entirely, get the extra funds, if they have any heart at all, they will pay. |

I would contact my financial institution and ask them to forgive the overdraft fees as a courtesy. I bank with a credit union and they're great to work with. They've forgiven the overdraft fees twice I think (in about three years of banking with them).
The only negative thing your financial institution can say is "sorry" and that they cannot do that. But if you explain to them your circumstances chances are they might forgive you. Try it. |

Usually a bank will cut you some slack when it is truely something not your fault because they want to retain your business. I would call your bank and ask to talk to management and nicely explain what happened and chances are they will reverse the fees. If not then I would approach your work and ask them to cover said fees, they may or may not. Also, inquire as to what happened so it doesnt happen again. If this is something that they cant control then you may want to stop doing direct deposit. |
