I'm so sorry to hear about your father. You would need to either look at his will and/or talk to his attorney. It all depends on how many siblings and your father's choice. |

if he has no will . All his bills will be paid first. After his bills are paid His belongs will then be divided among his surviors. meaning immediatly family. |

His will should outline this information. If he doesn't have a will, the next of kin is probably the most likely to have legal right to his belongings. |

You usually go by what he left in his will. If you think it is unfair you can contest it. Usually if he leaves you anything, then you won't get anything when you contest. But if you didn't recieve anything then you may. If he didn't leave a will then it would go to his spouse first and then his children. |

Check out his will.
Otherwise everything is left to his debt and the government. |

if your father was married, then his estate is typically left to his widow. if you were mentioned in his last will and testament, then you would be asked to attend the reading.
if the person who receives the estate is not you, you can try to contest the will, but you will need legal assistance.
this happens most often if the party who benefits is a step-parent or someone who is non-family.
if you are just hoping to have an item or two to remember him by, then ask the estate holder if you could have them. i hope that they would respect the situation enough to grant you certain items.
the worst situation is to forget your father's memory and turn the whole ordeal into something based on greed and selfishness.
i'm sorry for your loss and i hope you find what you're looking for. |

After you find his will seek legal counsel to have someone ensure you are taking what is yours and not someone else's.
PS: My condolences that is horrible news! |

The legal right to his belongings was given to you the day you were born. Ask your mother. |

only what is in his will, and that your mother/his wife lets you have. If it is half to his wife and half to the kids you go from there, if it is all to his wife, be nice ,kind and ask for what it is you want and maybe she will let you have it. |
