No, once a person has been tried and aquitted of a crime in America, they are free. There is a law called double-jeopardy which prevents prosecuters from trying a person twice. But a person can be sued for in a civil court after being aquitted in a criminal court. This is what happened to O.J. Simpson after he was aquitted of murdering his ex.

There's such a thing as double jeopardy: forbids a defendant from being tried a second time after having already been tried for the same crime. I don't think that applies to murder, tho? something about the state can try someone for murder then the government can do the same. Not totally sure on that point.

I'm not sure...doesn't double jeopardy come into this somewhere, or is that just in murder cases?
MumboVonJumbo
nope double jeopardy prevents this, if not the government could torment the innocent for decades

No, once a trial has taken place and the person has been acquitted, he can stand up and swear that he is guilty and the police can't do anything about it. That's double jeopardy.

No they can not be tried again. and no it's not called Double Jeopardy either. Once you are aquitted of a crime you can NOT be tried again regardless of what "new" evidence comes up... TOO F*&KING LATE!!!!!!!!!!!

Actually i don't think they can be tried for the same crime. it's called double jeopardy. but i think they can if they change the charge to something different.
