Do not issue a new check until you have the returned check in your hands. It is abnormal for someone to not cash a check for so long. You are probably not legally required to issue her a new check, since it is clearly noted that it is good for one year only. |

she earned the money, so you should pay her. make her bring the old check with her so you can destroy it before you give her a new one. if she cant bring it in, call her bank to verify they have voided it... do what is right |

You are right. You are legally bound to pay her for that amount. Even though she waited till it was expired, she still worked the hours and should still get paid for hours worked. If you don't issue another check you may be paying more in the future if ya know what i mean ;) |

that is totally up to u and ur company. I would be under suspision, why did she wait over a year to want to cash the check. Most people do not wait that long to cash or deposit a check especially a payroll check. U are not obligated to write her a new check, but could for your own "karma points." |

I think it would be a nice thing to do. The money is legally hers and she deserves it. You should ask her why she did not come to you sooner. Sometimes employees are scared to talk to their bosses because..well..you are their bosses.
