Contact your state's Labor Department. I'm not sure the specific's, but there are state and federal laws governing when an employer has to pay you. If it's an expense account or piece work it may be more complicated, but as far as wages are concerned, they cannot keep paying you late.

Contact the labor board and ask them if this is any kind of violation. If it is, inform your boss of it and see how he reacts to it. Maybe that alone will tighten up his ship.
Or, tell you boss you need to be paid on time (maybe negotiate and say or within 3 days) because you have bills you have to pay and on time at that and that you don't want to get evicted or not have money for food or ruin your credit because you boss can't pay you on time.
You really ought to regularly look for another job, religiously until you find one since you live in a small town but keep this job until you do. There is a high possibility he's doing this because the funds aren't there and the business isn't as stable as it needs to be. He's obviously holding onto the funds for a reason and no reason benefits you. |

I went through this last year when I left a steady, well paying job for an unsteady, well paying job. It is funny how an employer does not create a budget and assure that his business venture is possible with the revenues being made. Instead, the money he makes goes into paying his personal bills first. I had that happen, too.
My suggestion is to call the Department of Labor's wage and hour division. You can find them on-line. They will direct you to your local office. Please note that you will not get any premium overtime if you complain. They will only pay you straight time for time worked. AND, the government only requires the employer to pay you minimum wage. I would also check your state agencies.
Ultimately, I found a new job where I am well paid and paid on time. Like clock work...THANK GOODNESS! And then, I got cancer. So, I am still employed but not the way I want to be. I am on ST Disability for my surgery and want to go back to work really bad. I hate sitting around!
Good luck and I wish you the best. And, maybe you could do something on your own. If you are not getting paid, couldn't you do something that will pay you back in the end? Just a thought...

Your local Department of Labor office may be able to help you and your other coworkers get paid on time. (The Dept of Labor is the unemployment office). Most states have limits on the number of days which pay can be held back. The Dept of Labor would be the agency responsible for enforcing the regulation. |

I recommend making an invoice a week in advance before payday and putting it on his desk. Then remind him the day before. If that doesn't work, have a sit down with him and explain that you have bills that need to be paid on time, so you hope you can expect a set time to receive a paycheck. |

Talk to him or her. Schedule a meeting with your boss and calmly explain your situation. He/she will most likely understand. It could help you a lot. Or, send an email. Hope this works! |
