if you give someone your "power of attorney" you sign some papers that lets them make decisions for you, act for you in a legal sense.


Some people do this for business reasons, or because the first person is ill, and needs someone to handle legal stuff.

You NEVER give this to someone if you don't trust them completely.

It is where someone signs over legal authority to act in certain situations on their behalf. However, you can only act in the capacity that the PofA allows. Having PofA over someones DOES NOT mean that you have control over everything that person does and have final authority on all decisions regarding that person (unless you have been appointed by the courts to have custody over someone - say an aging parent who can't make medical or financial or legal decisions on their own). The PofA will specifically say what areas the other person can and can not act on.

A PofA could be as complicated as a situation where a parent is incapable of making decisions on their own (sometimes you can be granted PofA by the courts, sometimes they can realize they are going to need help and will voluntarily give PofA to someone - this is how a lot of older people get screwed by friends/family that they trusted). But, it could also be something as simple as having a spouse that is in the military or travels a lot and therefore gives you PofA to make financial decisions (sell vehicles, close on houses, take out loans) while they are away.

When you sign a letter in front of a Notary Public designating a specific person to make decisions for you. There are different ones, such as for financial decisions only, for medical decisions only, and some that include both. Be careful who you assign, financial POA gives them access to your money accounts. The medical POA known as Durable Power of Attorney for Healthcare, gives them power to stop life support among other things.

If someone..for example your father, is physically or mentally incompacitated and is unable to make decisions on their own. You can, thru legal channels, get the power to make decisions for them, keeping you fathers best interest in mind. For example using his money to pay his bills, medical decisions, etc. I'm sure you have to contact a lawyer to draw up the paperwork to make it legit.

now lets say you have 4 sisters and your mom gives you power of attorney when it comes down to caring for her and doing her finacial stuff it is your responiblity but you have control of her bank account and everything else even if all your other sister dont want to sell your moms house it is your choice but thats an example hope i gave you a idea

It means an attorney can speak for those who cant', like an elder, a youth underaged during a divorce, who doesn't want to go live with daddy, etc.....

It also applies to men away from home a lot, giving power of attorney to the wife, if he isn't able to make it back to her...

If a parent has court appointed power of attorney over there daughter who is mentally slow a little she can live and do thing on her own bit rodents always make the right decisions . Can they stop her from getting married ,she is 27 years old and pregnant with my friends baby.
