When bailiffs come knocking what can they take?
Can they take things like fridge/freezer, cooker, washing machine or anything electrical that belongs to a child (eg ps2, nintendo ds).

Some idea of what they can take would be helpful rather than;
"they can take anything they want"

Some collection agencies will threaten to send someone to your home if you refuse to pay them the amounts they request.

This is not a bailiff, they are simply a representative of a Debt Collecting Agency and have no powers at all. You do not need to speak to them if you do not wish to.

A bailiff is someone who works on behalf of the courts. They can be used to take items from your home when you have not made a payment to one of your debts and they can also be used to repossess your home or to enforce certain arrest warrants. Here we are looking at the role of the bailiff when seizing goods.

Bailiffs can be used to seize goods for payment of arrears on all kinds of debt such as council tax arrears, child support arrears, debts in either the county court or High Court, national insurance, VAT and tax. There are several types of bailiff and it is important to find out what debt the bailiff is collecting as the rules and the law are slightly different in each case.

Before bailiffs can act they will first receive instruction by the issue of a warrant, which will specify how much you owe. How a warrant is issued and whether it can be stopped is dependant on the type of debt involved.

If the bailiff is enforcing a debt which has gone to either the county court or High Court, you can apply to the court to have the bailiff's action suspended. Where the bailiff is acting on behalf of the county court you will need to fill in an N245 - Application to Suspend the Warrant. This form can be obtained directly from your local county court or downloaded from the court service web site at www.courtservice.gov.uk. You will need to complete the form and make an offer of payment. Instructions on how to complete it are contained on the form itself. You should then send the form (along with the relevant fee) to your local county court. In the High Court you will need to apply for a Stay of Execution. They can take anything to the value of your debt, but they will always start with things not essential to living such as TV,s DVD,s etc. Unfortunatley the kids Ps2 will be the first to go as they are luxury rather than essentials.
It is very unlikely they would ever touch your kitchen equiptment

Yes he can take everything but a bed and cooking equipment basically. They won't touch clothes because their resale value is minimal and they are an essential item

I think they can literally take anything that they think is worth taking, providing they leave the absolute basics (bed etc). They can take childrens stuff, but (i believe?!) some bailiffs have a bit of discretion. I imagine they'll certainly look through a childs room at least - if they couldn't touch it you'd be hiding all your valuables in there! They can't take the tools of your work, or anything that isn't yours, but if they want to take either of these you'll need proof that this is the case.

I used to know a bailiff, and they said it was pretty horrible after someones stuff had been taken, so please do all you can to stop them coming. It's definitely an experience you want to avoid.

bailiffs can take if stuffs belong to you such as,electrical stuff, furniture, car, cooker, fridge/freezer, washing machine, microwave etc. They might change the lock of the property or the business. So beware of the BAILIFFS.

i dont think they can take childrens stuff but yeah they can take pretty much everything else. including your car if you have one

they will take everything of value that's in your name, as for PlayStation/ Nintendo not very likely, but the tele, fridge/freezer cooker or any other electrical appliances yes defiantly

They won`t take your cooker or beds the rest yes, if anything in on HP and if you can prove it they won`t take that, they will take up to the Value of the warrant and yes they will take you seats

They can take anything and everything . They usually won`t take the clothes you`re wearing .

A friend had her house practically emptied by the bailiffs and, yes, they did take her teenage daughters pc.

They can't take anything which still has Hire Purchase outstanding on it.

They can't take anything that does not belong to you. You would need to be able to prove that though.

You shouldn't be asking this question! You should be dealing with why they are wanting to take your goods.

Go to the Citizens Advice Bureau and ask to see a Debt Counsellor. They will help avert the Bailliffs and work out a plan to pay off your creditors.

You can refuse the Bailliffs access by not answering the door to them or by telling them you are "refusing them entry" and that you are seeking debt and legal advice.

Get advice as soon as you can - the longer it takes the higher your debt will become as Bailliffs add charges for each contact they attempt to make (phone calls, letters and visits).
