ChocLover | Who's fault is it? |
I ordered some clothes online from a catalogue and they were delivered by the postman while I was out. He left them in my green recycling bin as I wasn't there and he couldn't post them through the letterbox, he scrawled a note on the envelope of another letter posted to me to say he left the parcel in the bin. Unfortunately I didn't see this note in time and the bins were collected and emptied the next day, therefore I didn't get my parcel. I have emailed the catalogue company explaining this and have asked them to send me a replacement but should I have to pay twice or will they claim off Royal Mail?
The postman regularly leaves parcels in my bin when I'm not there but this is his own doing and not at my request. Additional Details Thanks for all the advice, I'm waiting for the catalogue company to respond. I don't think that I should be making phone calls and emails to Royal Mail, they were paid by the catalogue company to deliver to me and they haven't done this so surely it's the catalogue company that claims off them? |

The postman is the culprit. A dustbin is not a sensible place to leave a parcel. He should hand it to you and get you sign for it, or leave it with a neighbour, get them to sign, and post you a note, or leave a note asking you to collect from the sorting office. |

this is the postmans fault. he is supposed to leave them by your door not in a bin. I would take your case to the local postmaster and have them refund you your costs. |

Phone the catalogue and tell them you have not received the goods. They should not hold you liable for this. |

Ah well, just think of how happy you have made someone at the recycling depot! |

Postman definitely in the wrong. What a daft thing to do. Common sense dictates, putting something important in any type of bin is asking for trouble..Next time ask him to leave parcels in a shed or somewhere safe. (To be honest though you are a little at fault here for not specifying, if it's a regular postman just a quick conversation saying you want things left in such and such a place would have avoided this scenario) |

Well, if the postman has been doing this all the time, n u havent earlier told him not to put stuff in ur bin, it means u dont have any problem with him keeping ur stuff in ur bin.
so in this case u r the one at fault, since the postman wud have thought that u r fine with him doing so. |

Over here, when you are not home when a parcel gets delivered, they just leave you note saying you can come and pick it up at the post office yourself. Seems like a better idea than to dump it in a recylcing bin.
I don't think you got a case though. Certeinly not against the website, and the mail... man, that's such a bureaucratic monster, you'll never get anywhere with them. |

Him leaving any parcels for you other than in your designated mailbox is actually against any delivery services' policy, and is totally his fault.
Some companies will be okay with leaving a parcel- but only if you leave them a signed note authorizing them to do so. Even then, it is up to the discretion of the delivery person.
You should not only e-mail the catalogue company, but also the delivery service. Say that you expect another parcel, paid for by them, and that none of this is your fault or responsibility. Ask them to contact the catalogue company, and give them the information to do so.
Good luck :) |

Postman is at fault in every way here, anyone with an ounce of sense should think of all worse case scenarios...When are you back , early collection from refuse guys etc!!
He hasn't got a leg to stand on and you have evidence via his note... |

Since he has done it often and I'm assuming you have never complained about it, it has become a standard practice. I would say it is possibly your fault (however unfortunate).
If you wish to fight it though you could blame the royal mail and the postman, at least then you'll know your new postman won't do it.
EDIT: The main issue really is between you and the postman, you had an implied agreement that he left the items in the bin. Your failure to remove the item from the bin has caused the problem. To be honest you have probably told the catalogue people too much. Your best chance of getting your item resent would have simply have told them you hadn't recieved it - which is technically true and wouldn't protentially get your postman sacked for doing something you had allowed him to do in the past. And lets be honest... you've more chance of getting the item resent than getting compensation from Royal Mail. |

Only echoing what others have said...the postman should leave goods at a secure place. |

It's the postman's fault. He showed a massive lapse in judgement by leaving your mail IN A BIN. Maybe he thought it was a good idea at the time but the fact of the matter is, your parcel was never recieved and therefore he didn't do his job correctly. It's his duty to make sure you get your post, (him being a Post-Man) and that didn't happen. It's Royal Mail you have your argument with. Take your case to them, you shouldn't have to pay for their mistake.
Good Luck! |
