Am I employed full time or agency ??
I have worked for a company through an agency for approx 2 months. The company asked me to go full time which I did not want to do. I explained that I wished to stay agency and they said that I had until the end of the week to make this decision. I submitted my time sheets to the agency and on discovering I had not been paid rang them to find out why. They said that I was now staff and no longer working through the agency. As I had not signed any contract with the company I was suprised to hear this. I now wish to leave the company and do not know where I stand. Can I be staff without having signed any paperwork, particularly a contract. If I am still agency what notice do I need to give and to whom?? Any help with this would be very gratefully received.

On signing with the agency there was never any mention of this job becoming permanent and also when the offer was made of permanent employment, I did state that I would rather not do this. I have now been offered a better paid job and wonder where I stand with regard to notice period and whom I need to give this to. Also who do I claim my unpaid work from? Strictly speaking in law you do not have to have a written contract. Contracts can be valid if they are written, spoken or by conduct. What that means is even if you haven't signed anything, if you said that you would do the job and then you turned up on the first day and started doing it, then that would be enough to imply that a contract exists in which case the company's usual resignation procedure will apply - in the first six months it's usually one week's notice by either party.

However, it appears they have automatically transferred you over to permanent employment. Have you checked the terms of your agreement with the agency? It may say there that the job was temp to permanent and therefore the contract has been made when you started work there in the very first place.

Check your contract with the agency first and then if you have any queries, speak to personnel/HR at work and explain. I'm sure that they don't want to make you work there any more than you want to be forced.

Sounds very dubious.

You are employed by the agency and unless you have signed or agreed to anything else then you must go back to the agency and ask for a full explanation. They should pay you for what you have earned and have an obligation to do so.

Are you sure that your contract with the agency doesn't say otherwise. Again look into this fully and if you are 100% sure that your contract with them specifies that you submit your time sheet to them then they must pay you.
Do not be intimidated and if you still have no luck go to the citizen advice bureau.

well i don't have a job at the moment but theres something not quite right with the arrangement u've got going on at the moment. u cannot be a staff if u haven't signed anything yet with the company. what u need to do is revisit all documents u must have been given by the agency when u took up this position and read all the fine prints. if u see nothing dodgy, go to ur company and tell them about ur current situation so they Can clear things up. good luck and word of advice don't leave ur current employment until u find something else. its the reason i dont have a job now. lol

these things happen without you knowing if you don't want to be full time. you don't have to but i am sure they will sack you if you don't do what they say. as for the agency - change to another one

Altho' you may not have signed any contract, is there anything that you may have signed with the Agency said that if you temp'd out for X time, that you are then considered an employee of that company?

If this company is so bad after 2 months, why didn't you ask for re-assignment earlier?

I'd just be grateful that I'd have a job.

wow, what a fix...
submit your pprwk to the comp. for payment (first) and keep working for the company. I would stay on with them, and have the agency call you if they have something your interested in come up that interests you.
Then give your notice to the company that at that time you are leaving. Good luck!!!

call the employment agency, they had to receive a letter
suspending the contract with the Company and with a
letter of offering to hire you. The employment agency
may not know they are trying to do this. And you don't always have to sign a Contract with a new Employer
but if you told them you were leaving they should have
found a replacement. If you quit you are not eligible
for Unemployment so go talk to the Employment Agency
tell them you want to quit and work for them again and
that you are not interested in that job.

Usually when working for a company through an agency after three months (is the norm) you are given the option of being hired as staff by that assignment.

The difficulty with this is that if the company you're working for is paying more than they would pay if they just hired you privately. They are paying the agency, AND you. So they were trying to save money and have you as staff.
No, you didn't sign a contract, but in a lot of cases, you don't need to sign a contract to work. In fact, most JOBS, (not salalried) don't required it at all.

If you're done working with the company, call your agency, and them that you no longer wish to work at that position because you do not wish to be staff, and wish to be employed by them. After that let the person who signs your times cards know that you will no longer be working with them at that company. Be respectful and courteous (there's not need to burn bridges, that could be a good recommendation).
