Many employers will stipulate in contracts that company information is not to be shared or used other than for 'The company'.
Am employer, i believe, can sue for breach of contract, should they so wish.

Not if your in the uk data protaction act prevents this. Our Boss left the company and wrote a book, the company who published it advertised it and sent out flyers, everyone who worked for the company while he was boss got a flyer to their home address. We suspected that he had been using our customer list aswell and was reported, don't know the outcome tho.

Unless he is precluded, in writing, by contract to not use the list, or even be in the same business, it is up to the customers whether or not they want to do business with him. He does not seem to be breaking any laws without knowing all of the details of the situation.
