The Better Business Bureau won't be able to do a thing for you, so disregard those answers. They only take complaints about work performed by the company for customers. I'll tell you who to contact at the end.
As for your first question, yes, they can "force" you to work on your day off, if it's a right to work situation (ie., you're not in a union or contracted to work specific days). They have to give you a certain amount of advance notice, I believe though, if they change your schedule.
The second question is answered "no." Unless you are salaried, federal law says you must be given a 15-minute break every 4 hours, and paid overtime for any amount of time over 40 hours you work in a week (so if you only work 32 hours, including the 10 you worked that day, you don't qualify).
Every state is different - I'm answering pretty generally - the things I said are pretty universal in the U.S. As I said, the BBB won't do a thing. You need to contact your local Department of Labor (call City Hall or your congressman to find out what it's called in your city/county/state). Good luck. |

No one can FORCE you to work on your day off. They can ask, but that's all they can do. And I think you are required to have a break for every four hours you work and a lunch after your sixth hour working. Call the BBB or the Chamber of Commerce on them. |

Correct me if I'm wrong but I think that people who get paid salary can work either as little or as much hours (overtime included) and it doesn't matter because they get paid a lot. So to answer your question, yes if you expect to get the big bucks. |

They only have to give you 24 hour notice to work a shift, and unfortunately, in Texas, there is no law regarding breaks. It is left up to company policy. If company policy states that breaks are given, you might have an argument. If they expect YOU to follow company policy, you should be able to expect the same in return. |

With certain exceptions, 10 hours with no break may be a state dept. of labor violation. It is not a violation of FLSA (Fair Labor Standards Act) enforced by OHSA (Occupational Health & Safety Administration).
For example, in the State of Illinois, the law states the employer (unless a contract states otherwise) must provide a 20 minute unpaid break for every six hours of continious work. |

Every 4 hours your entitled to a 15 minute break.
Every 8 hours, your entitled to a 30 minute lunch break...
So, if you work 8 hours, your entitled to one 15 minute break after 2 hours, and then a 30 minute bread after 4 hours, then another 15 minute break after 6 hours.
And yes, they CAN force you to work 10 hour days if they tell you up front that is what they want. Anything over 8 hours, they have to pay you overtime!!
