You need to have proof that you created that work first.
ex: computer files created on a certain date
Go get a lawyer.
Alot of it depends on your contract with this employer.
If you were an independant contractor you should own the rights to your work.
If you were contracted out for the job, you might not own those rights to the work you created while employed by that employer.

If he "plagiarized" work that you did while under his employ then most courts will side with him. This is because he had ownership over your work and your ideas where generated through task which he instructed you to perform.
Intellectual property theft is a hard thing to prove. So you'd need plenty of proof that what ever it is that he's copied is something that you came up with on your own time and on your own without the aid of any device from a pen to a computer that was owned by your employer.
It will be especially tough on you if you have gone into business using an idea you claim to have came up with while still employed with your former employer. He'll say it was his idea and that you took it and ran....otherwise...why wouldn't you have stayed there and risen through the ranks helping his company to prosper.

They hire you to do things for them anything you do on company time belongs to the company. If you are on salary that may also belong to them. the reason companies file patents in employee's name is because it is easier to them.
Most companies have an agreement when you hire in.
