molly103_98 | Can a company instruct their employees to have no contact, even in personal life, with a former employee? |
An employee of our company recently quit their job. The company sent out a blanket wide "no contact order" via email to every employee in our company. There is no reason provided, and upon asking the question as to why, the response is only that it is up to the discretion of the president to provide that. The president is using his discretion to not provide any further information. Is this legal? I have the individual on my facebook friends list, but do not speak with him about company information. Not providing company information to anyone outside of the company is, of course, understood. |

As long as you don't contact that person on company time or use company resources your fine. If you check your facebook at work (even if you don't contact that person) you could be found in violation. |

Your personal life is YOURS - a company cannot forbid you from seeing someone outside of work. Obviously I wouldn't come in to work on Monday and tell everyone you hung out with the ex-employee all weekend, but really it is none of their business.
Yes, they do have the right to not give you a reason for the no contact order - Privacy laws protect the employee from information being given out about them.
As long as your Facebook account is just for your personal use and not a work thing, there is no reason to remove the person from your friend list. I would just make sure you have your privacy levels set to "friends only" so your boss can't check out your personal stuff. |

hello - you are allowed to have friends at work that remain friends outside of work. however, i would not contact this person during the workday in any way through work computer or work telephone or cell phone. If you have a personal computer on which to check your facebook during the day, I suppose you could, but frankly I would not do it during the hours you are working.
As long as you never discuss the company in any way, or your job etc., with the former employee you should be fine on the friends side outside of working hours.
It sounds like there is some sort of issue you may never know about, but if the person ever asks about the company, anyone else at the company or even how your job is,. I would be very clear and say something like:
I value our friendship. However, I am not going to discuss anything at all related to work or the company with you. I hope you can understand and respect that.
good luck - |

I am sure you have signed a non-disclosure form with your company. That form is so that you do not divulge any confidential or proprietary company information. This is done for the protection of companies and it's employees. This form prohibits you from talking to your former employee *only about company issues*.
Legally however, the company can not forbid you to contact the former employee about any personal matter. You would not be breaking the law even if this person contact's you at your workplace by any means. |

I doubt that it is legal. However, you should not contact him/her on company time or provide any company information to them. Sounds like some kind of lawsuit is pending. |

I wouldnot do it on the company computer. On your own time, this is unenforceable.
BUT, bear in mind, unless you are specifically covered by an employment contract or are a memeber of a labor union, you are an "at will" employee" and can be termninated , for any reason, or for no reason at all, at any time. |
