Can a former company pretend I still work there? They are even signing emails as if I do, with my name.?
I was recently laid-off for the reason of out-sourcing. I found out the company has not our-sourced and are continuing to internally do my job (just without me). Furthermore, they are pretending that I sill work there in the same job capacity by answering incoming email (main means of communication for my job) as me with my old company email address. Is this legal (let alone ethical)? Can a company fire someone for the reason described and then continue the same work with someone else pretending to be me? They are even signing the emails with my name.
No, that is a form of fraud. They are fraudulently using your identity which is illegal. As for firing you and having someone else do your same job, you have to call the labor board to find out your rights and proper course of action. Sounds like a shady company. You should get some legal representation before they use your identity for more than emails.

Personally, I think you should contact a business law expert. If nothing else, you could have a lawyer write a letter to the company and demand that they stop using your name and email.
Your company may have rules written in small print somewhere that allows them to do this so you should pull out all of your employee handbook and other information.
Again - a lawyer would be your best bet. After the lawyer bills you, you can take your former employer to court to pay the lawyer's bill, too.
