taking_the_cake | Can a person or company patent a 100% natural substance? For instance, hydrogen peroxide or vitamin C? |
I saw a company with a product that is basically just a pure natural product, and I thought I could easily sell the same product, assuming there was no patent on it.
I did notice there was a trademark for the name of the product, so I know that I could not use the same name, or anything too similar. |

No, you cannot. BUT if you add an ingredient you can. You can copyright the name of your product, like TJ's orange juice, but you cannot patent the juice. They are two different things. |

No. The product already exists. |

In the language of the statute, any person who “invents or discovers any new and useful process, machine, manufacture, or composition of matter, or any new and useful improvement thereof, may obtain a patent,” subject to the conditions and requirements of the law. The word “process” is defined by law as a process, act or method, and primarily includes industrial or technical processes. The term “machine” used in the statute needs no explanation. The term “manufacture” refers to articles that are made, and includes all manufactured articles. The term “composition of matter” relates to chemical compositions and may include mixtures of ingredients as well as new chemical compounds. These classes of subject matter taken together include practically everything that is made by man and the processes for making the products. So, if it exists in nature and you figure out a way to produce it or refine it, probably so. |

I don't believe so. They could patent the process to collect, extract, refine or concentrate the substance but not the substance itself.
If you can get the stuff easily you can sell it, assuming it's nothing that needs some sort of licensing to sell.
Good luck! |

A company can copyright a process to derive a 100 percent natural substance (i.e make an easy way to create hydrogen peroxide). T |
