Can my employer confiscate a gift that was sent to me by a client/vendor?
A vendor from a tradeshow sent me and several other employees some software as a gift and sample product. My employer claims that the software is company property since it was sent to me as an employee of the company. The gift was sent via UPS to the company address, but was addressed directly to me. The package was wrapped in gift ribbon and contained a letter addressed to me saying thank you for attending the tradeshow, and I hope you enjoy this product. Can the employer mandate that I use this gift for company purposes? Or is it my personal property that I can take home and use?

It depends. Does your employer have a policy about employees not accepting gifts from client/svendors.

If they do, you can't accept the gifts.

Read your employee manual to determine your rights regarding this matter.

You acquired the gift as a representative of your company. Technically it does belong to them. Some companies forbid their employees from taking any gifts from outside vendors or clients, so as to remain impartial when dealing with them.

To keep your job, I suggest you should declare to your company on all gifts given by clients/vendor...They might think that your clients/vendors are bribing you one way or another.

An employer is doing you a good turn if they do not terminate your employment for receiving a gift from a person/company you do business with on the employer's behalf.
One must offer to turn the gift over to the employer for that reason, but also to demonstrate to your employer that you are appreciated by the customer/supplier you work with.
