Can my work fire me for this or let me go?
So I have been off of work for the last 6 weeks and will be off until March 23 because of a hip replacement revision and I am currently covered under FMLA and getting short term disability benefits. My work has been very good and understanding with all of this. But my question is that soon after I go back to work me and my husband want to try for our first baby. Not right away but maybe 3 months after I go back. I have been told by my surgeon that as soon as I feel okay I can go ahead with this without restrictions. But I am concerned about getting fired from work from being off and then coming back and then try to get pregnant. I have put off this pregnancy thing already and hoped to be last year even. I am just afraid of what my work will do and what my rights are. Can anyone give insight?

Why would you tell your work you are trying to get pregnant?
You are under no obligation to tell them things like this. So don't.
FMLA works like this: If your company qualifies, every employee is entitled to up to 12 weeks unpaid FMLA covered leave in a one year period.
Once you hit the 12 weeks, they do not have to hold your job if you don't come back.
So, it looks like you are using up your entire 12 weeks leave this year, which means you could not get more time off before March 24, 2010.
Try to "plan" the baby to arrive well past that date and legally you would be covered.
But really, with the economy the way it is, you may not have a job by then anyway.

They can not fire you because you are pregnant. I believe it is sort of the same thing as the FMLA.

in canada by law they can't fire you but i doesn't mean when you go back you will have the same position. or they might layoff people .
