yes, sadly they can. if this is a condition of the job and they are not asking you to do anything illegal or of questionable moral turpitude then they have every right. even if it is across the street because they can say while you are at work you represent the company/business and want to uphold a certain standard. now whether or not this is right is whole other debate. |

Has there been a problem with housekeeping and smoking? like throwing buts on the ground? Maybe they are just doing it temporarily. But I do not see how they can tell you where to go when you smoke off of the grounds and off the clock. |

Unfortunately, GA has what is known as "at will" employment. Meaning they can pretty much fire you just because they feel like it.
If you need the job, I advise you to follow the rules. |

They don't have the right to tell you what to do with your free time (lunch breaks included). However, it's probably a bad idea to smoke across the street because if they fire you for it - it will be up to you to hire a lawyer and make a lawsuit against them. |

NO, are you kidding me.. thats ridiculous, if your on break, whatever you do is your business as long as you clock back in on time. If your not doing any harm to there business then yeah..
Only way they might be correct is if they have a sign outside saying smoke 30 feet away! |

If the company makes you wear something that has their company logo on it then yes, they can fire you for being across the street and smoking. Even if you are off the clock you are still a representative of their company. That holds true even if you are in regular clothes on the premises. But across the street in your own clothes, off the clock, I don't think there is much they can do about that. But they can also be an "at will" company which means they can fire you for anything they want to......hence the phrase "at will". I would check with your labor department. |
